Ordinance No. 16,076 ORDINANCE NO. 16,076 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GRANTING A SPECIAL USE PERMIT(SUP)FOR THE CONSTRUCTION OF A 190- FOOT-TALL MONOPOLE TELECOMMUNICATION TOWER AND ASSOCIATED FACILITIES IN THE GENERAL COMMERCIAL (GC) ZONING DISTRICT, LOCATED AT 8808 NEEDLEPOINT ROAD, OVER A 3,600 SQUARE-FEET PROPOSED LEASE AREA, ON AN APPROXIMATELY 57.26 ACRES PARCEL, ZONED GC; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXCECUTE AND THE CITY CLERK TO ATTEST TO SUCH PERMIT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the property located at 8808 Needlepoint Road, Baytown,Texas 77521, over a 3,600 square-feet proposed lease area, on approximately 57.26 acres of land, legally described as Tracts 9B-1, 23A-1,23B-1, 23C,23D,and 24D,Abstract 4W Bloodgood, is zoned GC; and WHEREAS, the proposal is to construct a 190-foot-tall monopole telecommunication tower and associated facilities within the GC zoning district; and WHEREAS, the Unified Land Development Code (ULDC) allows the issuance of a special use permit for the construction of a 190-foot-tall monopole telecommunication tower and associated facilities; and WHEREAS, the Planning and Zoning Commission (the "Commission") held a public hearing oil February 18th, 2025; and WHEREAS, on February 18, 2025 the Commission submitted its final report that is to be used by the City Council in its consideration of the amendment as set forth in § 7.44 of the ULDC, recornmending approval of the SUP with the following conditions: 1) Use: The only use authorized by this special use permit is the construction of a 190-foot- tall monopole telecommunication tower and associated facilities; and 2) Site Plan: The development of the subject property must generally comply with the submitted site plan; and 3) Development of any wireless communication facility shall meet the requirements of Sec. 2.37 of the City of Baytown's Unified Land Development Code. And WHEREAS, the City Council held a public hearing on the SUP on February 27, 2025; and WHEREAS, after the public hearing, the City Council discussed and considered the SUP; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the facts and recitations contained in the preamble of this ordinance are hereby found and declared by the City Council of the City of Baytown,Texas, to be true and correct. Section 2: That the City Council of the City of Baytown,Texas, hereby grants the Special Use Permit, which is attached hereto as Exhibit " A" and incorporated herein for all intents and purposes,to the lease area of the subject site for the construction of a 190-foot-tall monopole telecommunication tower and associated facilities. Section 3: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute and the City Clerk to attest to the Special Use Permit,which is attached hereto as Exhibit " A.". Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas.
