AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT OF FIVE HUNDRED FORTY-NINE THOUSAND,
TWO HUNDRED SEVENTY-TWO DOLLARS AND 24100 ($549,272.24) TO
INTERMOUNTAIN SLURRY SEAL, INC., FOR THE PURCHASE AND
INSTALLATION OF MICRO-SURFACING, THROUGH A COOPERATIVE
PURCHASING AGREEMENT WITH THE CITY OF NORTH RICHLAND HILLS;
MAKING OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for
cooperative purchasing with the City of North Richland Hills; and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids
received by the City of North Richland Hills; and
WHEREAS, the City of North Richland Hills has taken bids for the purchase and installation of
micro-surfacing from Intermountain Slurry Seal, Inc.; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment of FIVE
HUNDRED FORTY-NINE THOUSAND, TWO HUNDRED SEVENTY-TWO DOLLARS
AND 24 100($549,272.24)to Intermountain Slurry Seal, Inc.,for the purchase and installation of micro-
surfacing, through a cooperative purchasing agreement with the City of North Richland Hills.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated§252.048,
the City Manager is hereby granted general authority to approve any change order involving a decrease or
an increase in costs of FIFTY THOUSAND AND NOI100 DOLLARS ($50,000.00) or less, provided that
the original contract price specified in Section 1 hereof may not be increased by more than twenty-five
percent (251 o) or decreased by more than twenty-five percent (251 o) without the consent of the contractor
to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
