Ordinance No. 16,044 ORDINANCE NO. 16,044 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GRANTING A SPECIAL USE PERMIT (SUP)TO ALLOW FOR THE CONSTRUCTION OF A RESIDENTIAL ACCESSORY STRUCTURE PRIOR TO THE CONSTRUCTION OF A PRINCIPAL STRUCTURE IN THE ER (ESTATE RESIDENTIAL) ZONING DISTRICT, LOCATED AT 1112 KILGORE ROAD, ON APPROXIMATELY 2.96 ACRES OF LAND, ZONED ER; AUTHORIZING T14E CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO SUCH PERMIT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* %V1IEREAS the property located at 1112 Kilgore Road, Baytown, Texas 77520, on approximately 2.96 acres of land, legally described as Lot 2, Dunnam-Rogers Addition, is zoned ER; and 1411EREAS, proposal is to construct a residential accessory structure, a carport, on the subject property without a principal structure within the ER zoning district; and WHEREAS, the Unified Land Development Code (ULDC) allows the issuance of a special use permit for the construction of a residential accessory structure prior to the construction of a principal structure in the ER zoning district;and WHEREAS, the Planning and Zoning Commission (the "Commission) held a public hearing on December 17, 2024; and WHEREAS, on December 17, 2024 the Commission submitted its final report that is to be used by the City Council in its consideration of the amendment as set forth in Section 7.23 of the ULDC, recommending approval of the SUP with the following conditions: 1. The size of the carport shall be limited to a maximum of 1,200 square feet; 2. Besides electricity and water, no other utilities shall be permitted to be connected to the carport; 3. All permits required for the construction of the carport shall be obtained within 60 days of the effective date of approval of this Special Use Permit; and 4. The approved accessory structure or any recreational vehicle on the site shall not be occupied as a residence. WHEREAS, the City Council held a public hearing on the SUP on January 23, 2025; and WHEREAS, after the public hearing, the City Council discussed and considered the SUP; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the facts and recitations contained in the preamble of this ordinance are hereby found and declared by the City Council of the City of Baytown, Texas ("City Council") to be true and correct. Section 2: That the City Council of the City of Baytown, Texas, hereby grants the Special Use Permit, which is attached hereto as Exhibit"A"and incorporated herein for all intents and purposes, to the owner of 1112 Kilgore Road, Baytown Texas 77520 to construct a 30' x 40' carport on the listed property prior to the construction of a principal structure. Section 3: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute and the City Clerk to attest to the Special Use Permit, which is attached hereto as Exhibit"A". Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas.
