CC Resolution No. 2962RESOLUTION NO. 2962 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REPEALING AND REPLACING RESOLUTION NO. 2145 FOR THE PURPOSE OF AMENDING THE PROCEDURAL GUIDELINES FOR THE SELECTION OF THE MAYOR PRO TEM CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas hereby repeals and replaces Resolution No. 2145 to amend its Procedural Guidelines for the Selection of the Mayor Pro Tern City of Baytown, Texas, which Guidelines, as amended, are attached hereto as Exhibit "A" and are incorporated herein for all intents and purposes. Section 2: All resolutions or parts ofresolutions inconsistent with theterrnsof thisresolution are hereby repealed; provided, however, that such repeal shall beonly to the extent ofsuch inconsistency and in all other respects this resolution shall be cumulative of other resolutions regulating and governing the subject matter covered by this resolution. Section 3: Any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this resolution or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this resolution or their application to other persons orsets of circumstances and to this end all provisions of this resolution are declared to be severable. Section 4: This resolution shall take effect on February 1, 2025. INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown, Texas this the 23n day of December 2024. ayor 0 APPROVED A '` A'i+� SCOTT LE_D, City Attorney R Ordinances and Resolutions Resolution Draiis-City Council- 12-23-2024 Resolution -Mayor Pro Tern - W ITH a.dncx PROCEDURAL GUIDELINES FOR THE SELECTION OF THE MAYOR PRO TEM CITY OF BAYTOWN, TEXAS ESTABLISHMENT OF POSITION: Baytown City Charter - Article 11, Section 15 The council shall elect a mayor pro tem who shall act as mayor during the absence or disability of the mayor and, if a vacancy should occur, shall become mayor until another mayor is appointed or elected in accordance with section 16 to fill the unexpired term. SELECTION GUIDELINES: Process: Each Council Member and the Mayor shall have the duty to consider these guidelines and all factors surrounding an individual's election to the office of Mayor Pro Tem and shall thereafter vote in the best interest of the entire City. 2. Unless voted otherwise by the City Council, the office has a one-year term commencing at the call to order of the first meeting after all new Members are sworn in. The office will be filled by an election by the City Council from within the City Council by a majority vote of those in attendance. 3. Prior to the election, the prospective Mayor Pro Tem shall: a) have reviewed the duties and responsibilities of BOTH the Mayor Pro Tem AND the Mayor; b) state at the meeting at which he or she is elected that he or she understands and agrees to fulfill all the duties and responsibilities of the office of Mayor Pro Tem; and c) have served on Council for at least one year. 4. It is expected that each Council Member present will vote (not abstain) at each election of the Mayor Pro Tem. Considerations: The Mayor and each Council Member shall consider the following factors in electing a Mayor Pro Tem: 1. Demonstrated leadership skills with Council and City management; 2. Organizational skills; 3. Interpersonal skills in working with Council and city management; 4. Experience with and. -'or knowledge of the functions of city government; 5. Responsiveness to time deadlines on Council activities; 6. Demonstrated availability of time and willingness to devote the time; and 7. Demonstrated availability for promptly called special meetings -- both full Council Meetings as well as administrative and informational meetings.
