Ordinance No. 16,004 ORDINANCE NO. 16,004 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, RESCINDING ORDINANCE NO. 15,958, REGARDING THE PURCHASE OF CISCO NETWORK EQUIPMENT SUPPORT FROM PRESIDIO NETWORK SOLUTIONS GROUP, LLC THROUGH THE TEXAS DEPARTMENT OF INFORMATION RESOURCES COOPERATIVE PURCHASING AGREEMENT (DIR-TSO-4167); AUTHORIZING THE PAYMENT OF SEVENTY-ONE THOUSAND FIVE IIUNDRED SIXTY-THRE'E DOLLARS AND 96100 DOLLARS ($71,563.96) TO PRESIDIO NETWORK SOLUTIONS GROUP, LLC, THROUGH THE INTERLOCAL PURCHASING SYSTEM, FOR THE PURCHASE OF CISCO NETWORK EQUIPMENT SUPPORT(SMARTNET); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, on October 24, 2024, the City Council approved Ordinance Number 15,958 authorizing the purchase of Cisco network equipment support(SmartNet)from Presidio Network Solutions Group, LLC through The Texas Department of Information Resources cooperative purchasing agreement (DIR-TSO-4167); and WHEREAS, the City's cooperative purchasing agreement with the Texas Department of Information Resources, specifically DIR-TSO-4167, expired prior to the purchase of the Cisco network equipment support (SmartNet),as authorized via Ordinance Number 15,958; and WHEREAS, the City Council of the City of Baytown is a member of the Interlocal Purchasing System, which authorizes such system to take bids for certain items and for the City of Baytown to make purchases based upon bids received; and WHEREAS, the City is able to purchase the Cisco network equipment support (SmartNet) from Presidio Network Solutions Group, LLC through The Interlocal Purchasing System("TIPS") ; and WHEREAS, The Interlocal Purchasing System has taken bids for the Cisco network equipment support (SmartNet); NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby rescinds Ordinance Number 15,958, authorizing the purchase of Cisco network equipment support (SmartNet) from Presidio Network Solutions Group, LLC through The Texas Department of Information Resources cooperative purchasing agreement(DIR-TSO-4167), in its entirety. Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes the payment of SEVENTY-ONE THOUSAND FIVE HUNDRED SIXTY-THREE DOLLARS AND 96 100 DOLLARS ($71,563.96) to Presidio Network Solutions, Group, LLC, for the purchase of Cisco network equipment support (SmartNet)through Texas Interlocal Purchasing System. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO 100 DOLLARS ($50,000.00) or less, provided that the original contract price specified in Section 1 may not be increased by more than twenty- five percent (250 o) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
