2024 07 11 CC Minutes MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN July 11, 2024 The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, July 11, 2024, at 6:30 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market Street, Baytown,Texas, with the following in attendance: Sarah Graham Mayor Pro Tern Laura Alvarado Council Member Kenrick Griffith Council Member James Franco Council Member Mike Lester Council Member Brandon Capetillo Mayor Jason Reynolds City Manager Kristin Holmes Assistant City Attorney Shannon Bennett Clerk Records Supervisor John Stringer Sergeant at Arms Mayor Brandon Capetillo convened the July 11, 2024 Regular City Council Meeting with a quorum present at 6:31 P.M. All members were present with the exception of Jacob Powell. The Pledge of Allegiance and Texas Pledge were led by Council Member Laura Alvarado. Invocation was led by Pastor Eric Bolenbaucher. Mayor Brandon Capetillo announced he will take points of privilege to provide an overview of the Hurricane Beryl aftermath and to pay respect to fallen Deputy Fernando Esqueda of Harris County with a moment of silence. 1. CITIZEN COMMENTS Mayor Brandon Capetillo announced no citizens signed up to speak. 2. MINUTES a. Consider approving the minutes of the City Council Regular Meeting held on May 9, 2024. b. Consider approving the minutes of the Joint City Council and Baytown Municipal Development District Meeting held on May 23,2024. City Council Regular Meeting Minutes July 11,2024 Page 2 of 9 A motion was made by Council Member James Franco and seconded by Council Member Laura Alvarado to approve the minutes of the City Council Meetings held on May 9, 2024 and May 23, 2024, as submitted. The vote was as follows: Ayes: Mayor Brandon Capetillo,Mayor Pro Tem Sarah Graham,Council Member Laura Alvarado,Council Member Kenrick Griffith,Council Member James Franco, and Council Member Mike Lester Nays: None Other: Council Member Jacob Powell (Absent) Approved 3. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Recognition and presentation of awards to fire personnel who responded to a ship fire in La Porte and rescued a victim. Fire Chief Kenneth Dobson presented Baytown Fire Department Personnel with a certificate and acknowledged their assistance at a ship fire in La Porte,that concluded with the rescue of a victim. 4. SPECIAL DISTRICTS BUDGETS FOR FISCAL YEAR 2024-2025 a. Receive the Baytown Fire Control, Prevention, and Emergency Medical Services District Fiscal Year 2024-2025 Adopted Budget. b. Receive the Baytown Crime Control and Prevention District Fiscal Year 2024-2025 Adopted Budget. Mayor Brandon Capetillo pushed Items 4.a., and 4.b., to the July 25, 2024 City Council Reg- ular Meeting due to Hurricane Beryl. No action was taken. 5. UNIFIED LAND DEVELOPMENT CODE (ULDC) a. Conduct a public hearing regarding the repeal and replacement of the City's Unified Land Development Code (ULDC) and Zoning map. At 6:46 P.M., Mayor Capetillo opened the public hearing regarding Item 5.a., the repeal and replacement of the City's Unified Land Development Code(ULDC) and Zoning map. Planning and Development Assistant Director Ryan Hvitlok summarized the subject matter of the hearing. Mayor Capetillo announced a citizen had signed up to speak regarding this Item. Theresa Blackwood, 113 Crow Rd, expressed her opinion regarding a summarized version of the City Council Regular Meeting Minutes July 11,2024 Page 3 of 9 changes that would take effect regarding the repeal and replacement of the City's Unified Land Development Code(ULDC)and Zoning map that could be readily available to residents. At 6:51 P.M., Mayor Capetillo closed the public hearing regarding Item 5.a., the repeal and replacement of the City's Unified Land Development Code(ULDC) and Zoning map. b. Consider an ordinance removing Section 5.29(b)(1)(j) from the Unified Land Development Code (ULDC). Mayor Brandon Capetillo pushed Item 5.b.,to the August 08, 2024 City Council meeting due to Hurricane Beryl. No action was taken. 6. REPORT a. Receive the 2024 Annual Baytown Report regarding the Economic Alliance Houston Port Region. President/CEO Chad Burke presented the 2024 Annual Baytown Report regarding the Economic Alliance Houston Port Region Report and highlighted the following: • Economic Development • Public Policy • Transportation/Infrastructure • Workforce Development • Quality of Life • Insights/Thought Leadership 7. CONSENT a. Consider an ordinance authorizing the closeout of the Neighborhood Street Re- construction of Fairway Drive and Savell Drive Project,and the release of retainage to Lucas Construction Company,Inc. Consider an ordinance authorizing the renewal of the Cityworks Asset Management Software from Azteca Systems,LLC. ORDINANCE NO. 15,855 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAY- TOWN, TEXAS, RENEWING THE CITYWORKS SOFTWARE CON- TRACT WITH AZTECA SYSTEMS, LLC, FOR THE SOFTWARE USED TO MANAGE, TRACK, AND ANALYZE ALL CITY INFRA- STRUCTURE ASSETS;AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN OF AN AMOUNT NOT TO EXCEED SEVENTY-SIX THOUSAND EIGHT HUNDRED SIXTY AND NO/100 DOLLARS ($76,860.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. c. Consider an ordinance authorizing the annual renewal of Central Square (aka Su- perion) software. ORDINANCE NO. 15,856 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAY- TOWN, TEXAS, AUTHORIZING PAYMENT IN THE SUM OF EIGHTY-SIX THOUSAND SEVEN HUNDRED THIRTY-ONE AND 94/100 DOLLARS ($86,731.94) TO CENTRAL SQUARE, F/K/A SU- PERION, F/K/A SUNGARD PUBLIC SECTOR INC., FOR THE RE- NEWAL OF THE SOFTWARE MAINTENANCE AGREEMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. d. Consider an ordinance authorizing the purchase of two hundred thirteen (213) Motorola APX N30 portable radios and related equipment from Motorola Solutions Inc. through the Houston-Galveston Area Council (H-GAC) for Public Works Engineering, Parks,Animal Control, and the Emergency Operations Division. City Council Regular Meeting Minutes July 11,2024 Page 5 of 9 Information Technologies Director Kevin Boatswain provided a detailed overview on Item 7.d., regarding the use of the radios within each department of the City of Baytown. Council Members expressed their concerns and opinions regarding the use of the radios. A motion was made by Council Member James Franco and seconded by Mayor Pro Tem Sarah Graham to approve Consent Agenda Item 7.d. Consider amending ordinance No. 15,453,passed on May 25,2023,which authorized the Interlocal Agreement with Harris County for the Garth Road Sidewalk from Seabird Street to Wallisville Road Project. This amendment increases the total amount of payment by the City of Baytown to Harris County. ORDINANCE NO. 15,859 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAY- TOWN,TEXAS,AMENDING ORDINANCE 15,453 WHICH AUTHOR- IZED AN INTERLOCAL AGREEMENT WITH HARRIS COUNTY FOR THE GARTH ROAD SIDEWALK FROM SEABIRD STREET TO WALLISVILLE ROAD PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED ONE HUNDRED SEVENTY-THREE THOUSAND EIGHT HUNDRED SIXTY-FIVE AND 08/100 DOLLARS($173,865.08);MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EF- FECTIVE DATE THEREOF. g. Consider an ordinance authorizing Amendment No. 4 to the Professional Services Agreement with Kimley-Horn and Associates, Inc. (KHA), for the Garth Road Widening Project to add additional funds for the design of Phases A to E. ORDINANCE NO. 15,860 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAY- TOWN, TEXAS, AUTHORIZING THE FOURTH AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH KIMLEY- HORN AND ASSOCIATES, INC., TO DESIGN AND INSTALLATION OF A LIFT STATION, THEREBY INCREASING THE CONTRACT AMOUNT BY TWO HUNDRED FIFTY-SIX THOUSAND AND NO/ 100 DOLLARS ($256,000.00); AND PROVIDING FOR THE EFFEC- TIVE DATE THEREOF. 8. APPOINTMENTS a. Consider a resolution authorizing the replacement of one(1) appointment to the Fire Control,Prevention & Emergency Medical Services District(FCPEMSD). MANAGER'S REPORT City Manager Jason Reynolds presented the Manager's Report: • Thanked City of Baytown Staff and citizens for all the contribution to assist with the Hurricane Beryl aftermath. • The City of Baytown has no control of the power outage and are in communication with the organizations that can assist with resolving the power outage. The City continues to stay in contact for any updates. • "It is of great importance to practice safety when using generators." • Mosquito Services will have a break-down of services provided in specific areas of Baytown on the City Website. • City Facilities that are currently without power will remain closed due to no power and are working to resolve this in a timely manner. o Wetlands o Municipal Court o Nature Center • The Green Center power line has been removed and is open for use. • The Permit Counter is available to provide services and will waive permit fees. • Debris pick-up will take time due to all guidelines being met with the contract and coordinating pick-up routes. Information will be posted on the City Website. City Council Regular Meeting Minutes July 11,2024 Page 8 of 9 • Thank you to David Alamia and Parks Department for establishing the chill zone for residents and will be working with Red Cross to relocate and extend services for residents to 710 Alamo. • Food Distribution partnered with Harris County Precint 2 from 12:00—2:00pm. • Red Cross will be distributing food with Baytown Locals. • A thank you to the below organizations for all the assistance during the power out- ages. o EXXON o Chevron Phillips Chemical (CP Chem) o Harris County Precinct 2 10. COUNCIL MEMBER DISTRICT REPORT a. Receive a report from Council Member Laura Alvarado regarding projects, pro- grams and events in District No. 1. Council Member Laura Alvarado reported the current projects,programs and events of District 1: • Public Works & Engineering o West Baytown Drainage — 90% complete. The County is reviewing the plans and hopes to begin the bid process by the end of the summer. o Market Street—Design is 95% complete. Last month GCCISD approved the sale of 3 parcels needed for the construction.The County is still working utility conflict issues with Centerpoint, and are waiting for a permit from Union Pacific. The County hopes to begin the bid process by the end of the summer. • Planning& Development o 3007 Garth—Proposed 6000 sq. ft.office building—In plan review stage. o 3203 Garth—New Hotel—Inn at Garth—Permit issued,no work started. o 1901 Rollingbrook—2 new Retail Strip Centers—Permit issued. o 501 S Atlantic—New Church—Plan in review stage. o 2711 N Main—New U-haul—Project is approx. 75% complete. • Hurricane Beryl Updates o Bus Transport for 55+community was cancelled due to power restored,but efforts were greatly appreciated. o Pallets of water donated at Guadalupe Church by EXXON was very helpful for those in need and the community had the opportunity to meet the new Pastor. o A big thank you to Corporal Brian Parker for his dedication to child car seat safety sessions. o Food Drive Volunteers still needed if interested reach out to 713-545-5953. 11. EXECUTIVE SESSION a. Recess into and conduct an executive session pursuant to Section(s) 551.071 and/or 551.087 of the Texas Government Code to seek the advice of the City's attorneys regarding City Council Regular Meeting Minutes July 11,2024 Page 9 of 9 pending or contemplated litigation and/or to deliberate regarding economic development ne- gotiations. At 7:42 P.M., Mayor Brandon Capetillo recessed and convened into an Executive Session. At 8:52 P.M.,Mayor Brandon Capetillo reconvened the meeting and announced that in accordance with Section 551.102 of the Texas Government Code, no action was taken in the Executive Ses- sion. 12. ACTION ITEM a. Take appropriate action regarding the City Manager's performance evaluation. Mayor Brandon Capetillo announced no action was taken and this item will be addressed at a future meeting. 13.
