Ordinance No. 15,880 ORDINANCE NO. 15,880 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, REPEALING AND REPLACING ORDINANCE NO. 15,688 AUTHORIZING THE PURCHASE OF THIRTEEN(13)CHEVROLET POLICE VEHICLES WITH RELATED EQUIPMENT AND INSTALLATION FOR THE POLICE DEPARTMENT FROM ED MORSE AUTOMOTIVE, LLC., D/B/A FREEDOM CHEVROLET BUICK GMC, THROUGH THE HOUSTON-GALVESTON AREA COUNCIL; AUTHORIZING PAYMENT IN THE AMOUNT OF ONE-MILLION SIXTY-FIVE THOUSAND, FIVE- HUNDRED, NINETY-SIX AND 13/100 DOLLARS ($1,065,596.13) TO RELIABLE CHEVROLET, THROUGH THE SHERIFF'S ASSOCIATION OF TEXAS VEHICLE PROCUREMENT PROGRAM FOR THE PURCHASE OF THIRTEEN (13) CHEVROLET POLICE VEHICLES WITH RELATED EMERGENCY EQUIPMENT AND INSTALLATION;MAKING OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS,the Sheriffs Association of Texas Vehicle Procurement Program is a cooperative bid program that provides Texas governments with vehicle offerings; and WHEREAS, Chapter 271 of the Texas Local Government Code authorizes the City to participate in cooperative purchasing programs; and WHEREAS, the Sheriff's Association of Texas has taken bids for Chevrolet police vehicles with related emergency equipment and installation;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of ONE- MILLION SIXTY-FIVE THOUSAND, FIVE-HUNDRED, NINETY-SIX AND 13/100 DOLLARS ($1,065,596.13) to Reliable Chevrolet, through the Sheriffs Association of Texas for the purchase of thirteen(13)Chevrolet police vehicles with related emergency equipment and installation. Section 2: Twelve(12)units shall be purchased using budgeted funds from the Baytown Crime Control and Prevention District Fiscal Year 2023-24 budget, in the amount of ONE-MILLION, FOURTEEN-THOUSAND, TWO-HUNDRED, EIGHTY-NINE AND 12/100 DOLLARS ($1,014,289.12). One(1)unit shall be purchased using insurance funds received from a totaled unit,in the amount of FIFTY-ONE THOUSAND, THREE-HUNDRED, SEVEN AND 01/100 DOLLARS ($51,307.01). Section 3: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent(25%) or decreased by more than twenty-five percent(25%)without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
