Ordinance No. 15,878 ORDINANCE NO. 15,878 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 2 "ADMINISTRATION," ARTICLE IV "BOARDS AND COMMISSIONS,"DIVISION 2"PARKS AND RECREATION BOARD," SECTION 2-281 "CREATED; MEMBERSHIP"; TO REMOVE THE APPOINTMENT DEADLINE; CONTAINING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That Chapter 2 "Administration,"Article IV "Boards and Commissions," Division 2 "Parks and Recreation Board," Section 2-281 "Created; membership" of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 2. ADMINISTRATION ARTICLE IV. BOARDS AND COMMISSIONS DIVISION 2. PARKS AND RECREATION BOARD Sec. 2-281. Created; membership. (a) There is created an advisory board which shall assist and advise the city council on the proper operation of the city's parks and recreational facilities. The board shall be known as the parks and recreation board. (b) The parks and recreation board shall be composed of seven members. Each city council member shall appoint one member to the board from their respective district. The Mayor shall make an at-large appointment to the board and designate the Chair. (c) Members shall hold office for three-year staggered terms. All members of the board shall be residents of the city. If vacancies occur in the board, such vacancies shall be filled in the same manner as original appointments, except such terms shall only be for the remainder of the unexpired term. Appointment of new board members will be done by the City Council. Terms of office will run from September 1 to August 31. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection,paragraph, sentence, clause or phrase of the ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not effect the validity of the remainingprovisions of this ordinance or their application to other persons or sets of pP circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council.
