2024 05 23 MDD Minutes Joint with CC MINUTES OF THE JOINT MEETING OF THE CITY COUNCIL AND THE BAYTOWN MUNICIPAL DEVELOPMENT DISTRICT May 23, 2024 The City Council and Baytown Municipal Development District (MDD) of the City of Baytown met in a Joint Meeting on Thursday, May 23, 2024, at 6:30 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market Street, Baytown,Texas, with the following in attendance: Laura Alvarado Mayor Pro Tem/Vice President Sarah Graham Council Member/Director Kenrick Griffith Council Member/Director Jacob Powell Council Member/Director Mike Lester Council Member/Director Brandon Capetillo Mayor/President Jason Reynolds City Manager/General Manager Scott Lemond City Attorney/General Counsel Angela Jackson City Clerk/Assistant Secretary John Stringer Sergeant at Arms Mayor / President Brandon Capetillo convened the May 23, 2024, City Council and Municipal Development District (MDD) Regular Joint Meeting with a quorum present at 6:35 P.M. All members were present with the exception of Council Member/Director James Franco. The Pledge of Allegiance, Texas Pledge, and Invocation were led by Mayor/ President Brandon Capetillo. Mayor Brandon Capetillo pulled Municipal Development District (MDD) Items out of order to address in Municipal Development District (MDD) Board prior to convening the City Council Meeting. 2. MINUTES a. Consider approving the minutes of the Baytown Municipal Development District Regular Meeting held on April 11,2024. b. Consider approving the minutes of the Baytown Municipal Development District Regular Meeting held on April 25,2024. A motion was made by Vice President Laura Alvarado and seconded by Director Kenrick Griffith to approve the minutes of the Regular Baytown Municipal Development District Meeting held on April 11, 2024 and April 25, 2024, as submitted. PROPOSED ORDINANCES c. Consider an ordinance to provide the disbursement request from the Hyatt Regency Hotel. General Counsel Scott Lemond informed the Board Members that Item 3.c should reflect as a resolution approved by the Municipal Development District(MDD)Board instead of an ordinance. General Manager Jason Reynolds addressed the Municipal Development District (MDD) Board Members to give an overview of the $600,000 transfer from the MDD to a built-in reserve trust fund for future possible expenses. Mr. Reynolds stated, "It is not anything to do with the deficit, it's just part of a part of how it's built into the contract". A motion was made by Vice President Laura Alvarado and seconded by Director Mike Lester to approve Resolution No. 476, related to Item 3.c. The vote was as follows: Ayes: President Brandon Capetillo, Vice President Laura Alvarado, Director Sarah Gra- ham, Director Kenrick Griffith, Director Jacob Powell, Director Mike Lester Nays: None Other: Director James Franco (Absent) Approved RESOLUTION NO. 476 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAY- TOWN MUNICIPAL DEVELOPMENT DISTRICT AUTHORIZING AND DIRECTING THE GENERAL MANAGER TO HONOR THE DIS- BURSEMENT REQUEST FROM THE HYATT REGENCY HOTEL FOR PAYMENT OF SIX-HUNDRED THOUSAND DOLLARS ($600,000.00) FOR THE REMAINDER OF FISCAL YEAR 2024 FOR THE PURPOSE OF COVERING SHORTFALLS OF THE MONTHLY OPERATING AC- COUNT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Mayor Brandon Capetillo closed the Municipal Development District Meeting and convened the City Council Meeting. 1. CITIZEN COMMENTS Mayor Brandon Capetillo announced citizens signed up to speak. Gary VanDerbeek, 4403 Crosby Cedar Bayou Road,provided the Board Members with an article addressing plumbing codes, in an attempt to provide solutions related to the dearmexa- tion of his residence. b. John Pacheco, 2805 New Castle Drive,requests Board Members provide some assistance with resolving his housing hardship case that was denied previously. Mr. Pacheco stated he is living in a residence that no longer meets standards for his family's medical needs. 2. MINUTES c. Consider approving the minutes of the City Council Regular Meeting held on April 25,2024. d. Consider approving the minutes of the City Council Special Meeting held on May 2nd & 3rd, 2024. e. Consider approving the minutes of the City Council Special Meeting held on May 7, 2024. A motion was made by Mayor Pro Tern Laura Alvarado and seconded by Council Member Jacob Powell to approve the minutes of the Regular and Special City Council Meetings held on April 25, 2024; May 2, 2024; May 3, 2024 and May 7, 2024, as submitted. The vote was as follows: Ayes: Mayor Brandon Capetillo, Mayor Pro Tern Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, Council Member Jacob Powell and Council Member Mike Lester Nays: None Other: Council Member James Franco (Absent) Approved 3. PROPOSED ORDINANCES a. Consider an ordinance authorizing the adoption of the Downtown Arts District Blueprint. Director of Planning and Development Martin Scribner provided an overview related to the Downtown Arts District Blueprint and the Baytown Economic Prosperity Roadmap. Mr. Scrib- ner clarified that the projects are not yet finalized and each project will require approval prior to moving forward with any projects. Assistant Director of Planning and Development Ryan Hvitlok,provided a high-level overview of Item 3.a.,related to the Downtown Arts District Blueprint. REPORTS a. Receive the City of Baytown's Quarterly Financial and Investment Reports for the Quarter Ending March 31, 2024. Finance Director Teresa McKenzie provided the City of Baytown Quarterly Financial and Invest- ment Report. (Exhibit B) Mayor Brandon Capetillo acknowledged the report was received. 6. CONSENT A motion was made by Council Member Sarah Graham and seconded by Council Member Kenrick Griffith to approve Consent Agenda Items 6.b., through 6.j., with the exception of Items 6.a., that were pulled for discussion purposes in Executive Session. MANAGER'S REPORT City Manager Jason Reynolds, provided a report to recognize the following Employees and De- partments: • City of Baytown Employee Recognition(Exhibit C) • Congratulated Madisyn Brownlee for receiving her Bachelor in Business Administration. • Lieutenant Renee Hinojosa for being accepted into the Law Enforcement Management In- stitute of Texas Leadership's Command College. City Council and MDD Regular Joint Meeting Minutes May 23,2024 Page 10 of 10 • Write-In: Advanced Interior Services thanked Nicole Swearengin in PWE for her quick response and professionalism. o A resident thanked the Traffic Team for resolving concerns on their road. • Thanked all Departments and Council for Storm Recovery assistance and ensuring repairs we're addressed. • Permit Fees waived for 30 days pertaining to residence with related storm and electrical damages. • Addressed an article in the local newspaper related to an urban development home with the Baytown Housing Authority. City of Baytown has no oversight or ability to address the matter. Mayor Brandon Capetillo thanked all the City of Baytown Employees assisting with recent storms. 8. EXECUTIVE SESSION a. Recess into and conduct an executive session pursuant to Section(s) 551.071 and/or 551.087 of the Texas Government Code to seek the advice of the City's attorneys regarding pending or contemplated litigation and/or to deliberate regarding economic development ne- gotiations. At 7:50 P.M.,Mayor Brandon Capetillo recessed and convened into an Executive Session pursuant to Sections 551.071 and/or 551.087 of the Texas Government Code to seek the advice of the City's Attorneys and regarding economic development negotiations. At 8:56 P.M., Mayor Brandon Capetillo reconvened the meeting and announced that, in accord- ance with Section 551.102 of the Texas Government Code, no action was taken in the Executive Session. 9.
