Ordinance No. 15,830 ORDINANCE NO. 15,830 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CHANGING, CONFIRMING, AND CORRECTING THE SPELLING AND IDENTIFYING NAME FOR THE ROADWAY NEAR THE INTERSECTION OF THE 6000 BLOCK OF BAYWAY DRIVE, NORTH OF CROW ROAD, CURRENTLY KNOWN AS BAYWAY DRIVE OR BROWN LOOP, AND TO FORMALLY ESTABLISH SAID NAME AS BROWN LOOP; PROVIDING FOR THE IMPLEMENTATION BY THE DIRECTOR; PROVIDING FOR SAVE AND EXCEPTION; PROVIDING FOR CONFLICT, PROVIDING FOR REPEAL; PROVIDING A SAVING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. ****************************************************************************** WHEREAS, the State of Texas delegated exclusive control over roadways in a municipality to its governing body; and WHEREAS, the City of Baytown, Texas ("the City") and Harris County, Texas staff identified the following roadway with conflicting names or spellings of names near the intersection of the 6000 block of Bayway Drive, north of Crow Road, within maps, deeds, plats, street signs and emergency response systems; and WHEREAS, the City desires to change, confirm, and correct the name and spellings of the roadway near the intersection of the 6000 block of Bayway Drive, north of Crow Road; NOW. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown does hereby adopt as a part of this ordinance the findings of fact as set out in the preamble to this ordinance and finds that the conclusions reached therein are true, correct and accurate and are incorporated into this ordinance by reference. Section 2: That the city roadway near the intersection of the 6000 block of Bayway Drive, north of Crow Road known and spelled as "Bayway Drive," also known and spelled as "Brown Loop," is hereby confirmed, corrected, and changed to Brown Loop. Section 3: That the director of Planning and Community Development or his designee is hereby authorized and directed to take those steps necessary to implement the name changes, confirmations, and corrections, and they are further directed to provide a copy of this ordinance to the following departments and other affected entities: (a) Department of Finance. (b) Baytown Fire Department. (c) Department of Planning and Community Development, (d) Police Department. (e) Department of Public Works. (f) Department of Utilities. (g) Contiguous municipalities, if any property abutting the street is within the contiguous municipality. (h) Harris County and Chambers Counties, as applicable. (i) TXU Electric Company or CenterPoint Electric Company, or its successor. 0) TXU Gas Company or CenterPoint Gas, or its successor. (k) Southwestern Bell Telephone Company, or its successor (1) U.S. Postal Service. (m) Water service providers. Section 10: Conflicts. That this ordinance shall control over all subdivision plats, street signs, maps, deeds, or any government record that conflicts with names of the roadways adopted within this ordinance. Section 11: Save and Exception. That any roadway name in an ordinance with a roadway name confirmed, changed, or corrected by this ordinance is hereby amended and, said name, is replaced with the name provided for in this ordinance; and the remaining ordinance shall remain in full force and effect, save and except as amended by this ordinance. Section 12: Repeal. That all ordinances or parts of ordinances, if any, in conflict with this ordinance shall be and are hereby expressly repealed and replaced to the extent of such conflict only. Section 13: Severability. That in the event any clause, phrase, provision, sentence or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair,or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Baytown, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts. Section 14: That this ordinance shall take effect immediately from and after its passage and shall be published in accordance with state law and Section 29, Article II of the Charter of the City of Baytown, Texas.
