Ordinance No. 15,829ORDINANCE NO. 15,829 AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING, FOR A PERIOD OF THIRTY (30) DAYS FOLLOWING A DECLARED LOCAL DISASTER PURSUANT TO SECTION 418.108 OF THE TEXAS GOVERNMENT CODE, THE WAIVER OF ALL DISASTER-RELATED BUILDING PERMIT FEES; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Southeast Texas generally, and the City of Baytown,Texas, specifically, is subject to the occurrence or imminent threat of widespread or severe damage, injury, or loss of life or property resulting from natural or man-made causes, including fire, flood, earthquake,wind, storm, wave action, oil spill or other water contamination, volcanic activity, epidemic, air contamination, blight, drought, infestation, explosion, riot, hostile military or paramilitary action, extreme heat, cybersecurity event, other public calamity requiring emergency action, or energy emergencies; and WHEREAS,in such circumstances,extraordinary measures must be taken to alleviate the suffering of people and to protect or rehabilitate property and infrastructure; and WHEREAS, in such circumstances, § 418.108 of the Texas Government Code authorizes the Mayor of Baytown to issue a Declaration of Local Disaster; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That, for a period of thirty (30) days following a declared local disaster pursuant to Section 418.108 of the Texas Government Code(the"Waiver Period"),the City of Baytown shall waive all building permit fees (as referenced in the Code of Ordinances, Baytown, TX, Chapter 2 Administration," Article V "Finance," Division 1 "Generally," Section 2-595 "Fees for Various City Services," Subsection (2) "Development Services," Sub-subsections (a) "Building permit: Commercial," b) "Building permit: Residential (c) "Demolition permit," (d) "Electrical permit: Residential," (e) Electrical permit: Commercial," (f) "Plumbing permit: Residential," (g) "Plumbing permit: Commercial," (h) "Mechanical permit: Residential," (i) "Miscellaneous building permit," and 0) Inspection and plan review (for building services only);" and Chapter 18 "Buildings and Building Regulations") related to damages caused by the local disaster. Section 2: That the Waiver Period shall begin on the first day after the commencement date of the disaster event as identified in the Declaration of Local Disaster without regard to the date the Declaration of Local Disaster is signed, issued, or published. Section 3: That the Waiver Period may be extended at any time by a majority vote of the City Council of the City of Baytown. Section 4: That the Director of Planning and Development Services or his or her designee(the Director"), may reject any request for a waiver under this ordinance upon a finding that the damage was not caused by the local disaster, the permit is not a "building permit" as defined in Section I of this ordinance, or for any reason not inconsistent with this ordinance. Section 5: That, should the Director reject a request for waiver under this ordinance, the Director's decision may be appealed in accordance with the provisions of the Code of Ordinances,Baytown, TX, Chapter 18"Buildings and Building Regulations,"Article 2,"Construction Board of Adjustments and Appeals." Section 6: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. Box 424 Baytown, Texas 77522-0424 (281) 420-6550  (281) 420-7176 Fax BRANDON CAPETILLO, MAYOR DECLARATION OF DISASTER WHEREAS, the CITY OF BAYTOWN, HARRIS AND CHAMBERS COUNTIES, TEXAS, on the 16th day of May, 2024, has suffered widespread electrical power loss and suffered damage, injury, or loss of life or property resulting from high winds, severe weather, flooding due to excessive rain, and a derecho wind storm. WHEREAS, the Mayor of Baytown has determined that extraordinary measures must be taken to alleviate the suffering of people and to protect or rehabilitate property and infrastructure, NOW, THEREFORE, BE IT PROCLAIMED BY THE MAYOR OF BAYTOWN, TEXAS: 1. That a local state of disaster is hereby declared for the City of Baytown, Texas pursuant to §418.108(a) of the Government Code. 2. Pursuant to §418.108(b) of the Government Code, the state of disaster shall continue for a period of not more than seven days from the date of this declaration unless continued or renewed by the City Council of Baytown, Texas. 3. Pursuant to §418.108(c) of the Government Code, this declaration of a local state of disaster shall be given prompt and general publicity and shall be filed promptly with the City Clerk. 4. Pursuant to §418.108(d) of the Government Code, this declaration of a local state of disaster activates the City of Baytown’s Emergency Management Plan. 5.
