AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, WAIVING, FOR THE
PERIOD MAY 17, 2024 THROUGH JUNE 17, 2024,ALL BUILDING PERMIT FEES
RELATED TO DAMAGES CAUSED BY THE RECENT STORM ON MAY 16, 2024;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, on the 1611 day of May, 2024, the City of Baytown, Texas suffered widespread
electrical power loss and suffered damage, injury, or loss of life or property resulting from high winds,
severe weather, flooding due to excessive rain, and a derecho wind storm; and
WHEREAS, as a result, the Mayor of Baytown determined that extraordinary measures must be
taken to alleviate the suffering of people and to protect or rehabilitate property and infrastructure; and
WHEREAS, on May 19, 2024, pursuant to § 418.108 of the Texas Government Code, the Mayor
of Baytown issued a Declaration of Local Disaster; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That, for the period May 17, 2024 through June 17, 2024 only,the City of Baytown
waives all building permit fees (as referenced in the Code of Ordinances, Baytown, TX, Chapter 2
"Administration," Article V "Finance," Division 1 "Generally," Section 2-595 "Fees for Various City
Services," Subsection (2) "Development Services," Sub-subsections (a) "Building permit: Commercial,"
(b) `Building pen-nit: Residential (c) "Demolition permit," (d) "Electrical permit: Residential," (e)
"Electrical permit: Commercial," (f) "Plumbing permit: Residential," (g) "Plumbing permit:
Commercial," (h) "Mechanical permit: Residential," (i) "Miscellaneous building permit," and 0)
"Inspection and plan review (for building services only);" and Chapter 18 "Buildings and Building
Regulations") related to damages caused by the recent storm on May 16, 2024.
Section 2: That the Director of Planning and Development Services or his or her designee (the
"Director"), may reject any request for a waiver under this ordinance upon a finding that the damage was
not caused by the recent storm on May 16,2024, the permit is not a"building pen-nit"as defined in Section
1 of this ordinance, or for any reason not inconsistent with this ordinance.
Section 3: That, should the Director reject a request for waiver under this ordinance, the
Director's decision may be appealed in accordance with the provisions of the Code of Ordinances,Baytown,
TX, Chapter 18"Buildings and Building Regulations,"Article 2,"Construction Board of Adjustments and
Appeals."
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
