AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING FINAL PAYMENT FOR THE BAYTOWN AREA
WATER AUTHORITY FILTER SCOUR IMPROVEMENTS PROJECT, IN AN
AMOUNT OF TWO HUNDRED EIGHTY-FIVE THOUSAND, THREE
HUNDRED SEVENTEEN AND 49/100 DOLLARS ($285,317.49) TO LEM
CONSTRUCTION COMPANY, INC.: AUTHORIZING THE CLOSEOUT OF
THE BAYTOWN AREA WATER AUTHORITY FILTER SCOUR
IMPROVEMENTS PROJECT; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.

WHEREAS, the City of Baytown contracted with LEM Construction Company, Inc., for
the Baytown Area Water Authority Filter Scour Improvements Project (the "Project"); and
WHEREAS, the City's engineer, in the manner provided by the terms of the said contract
and the plans and specifications thereof, has approved the Baytown Area Water Authority Filter
Scour Improvements Project, has heretofore issued his Certificate of Final Acceptance for the
completed portion of said project, has certified same to the City Council, and has recommended
that it accept and receive said work and improvements as constructed and completed by the
contractor; and
WHEREAS, the City Council accepted the Project authorized retainage in the amount
TWO HUNDRED EIGHTY-FIVE THOUSAND, THREE HUNDRED SEVENTEEN AND
49/100 DOLLARS ($285,317.49) for the Project herein accepted; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council, having previously accepted and approved the above-
described Project, authorizes final closeout of the Project in full accordance with all of the terms
and provisions of the aforesaid contract.
Section 2: That the City Council authorizes the release and final payment of the
retainage withheld for the Project, TWO HUNDRED EIGHTY-FIVE THOUSAND, THREE
HUNDRED SEVENTEEN AND 491100 DOLLARS ($285,317.49) to LEM Construction
Company, Inc.
3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
