CC Resolution No. 2915 RESOLUTION NO. 2915 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CITY COUNCIL RESOLUTION NO. 2674 TO REMOVE THE CITY MANAGER'S AUTHORITY TO APPOINT A MEMBER TO THE BAYTOWN POLICE ADVISORY COMMITTEE; ADDING THE APPOINTMENT OF AN INDIVDUAI_ WHO IS A LICENSED PEACE OFFICER AND CRISIS INTERVENTION TEAM MEMBER, TO BE APPOINTED BY THE CHIEF OF POLICE; REMOVING THE REQUIREMENT THAT ALL MEETINGS OF THE COMMITTEE BE SLIBJECT TO THE TEXAS OPEN MEETINGS ACT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, on August 31, 2020, the City Council passed Resolution No. 2674, which confirmed the Baytown Police Advisory Committee as a committee of the City and established its composition purpose and duties; and WHEREAS, Section 2c 1.Appointments, currently reads as follows: 1. Appointments. Each member of the City Council as well as the City Manager and the Chief of Police shall make one appointment to serve on the Baytown Police Advisory Committee. All appointments are subject to Council's approval, and such appointees serve at the pleasure of the City Council; WHEREAS, Section 2d.Meetings, currently reads as follows: d. Meetings. All meetings of the Committee shall be subject to the Texas Open Meetings Act; WHEREAS, the City Manager no longer desires to make an appointment to the Baytown Police Advisory Committee; and WHEREAS the Council desires to amend Resolution No. 2674 to remove the City Manager's authority to make an appointment to the Baytown Police Advisory Committee, add the appointment of an individual who is a licensed peace officer and crisis intervention team member to the Committee, such appointment to be made by the Chief of Police, and remove the requirement that all meetings of the Baytown Police Advisory Committee be subject to the Texas Open Meetings Act; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown hereby amends Section 2 of Resolution No. 2674 to read as follows: Section 2: The City of Baytown hereby confirms the Mayor's Community Engagement Advisory Committee and establishes it as the Baytown Police Advisory Committee as follows: a. Created; composition. There is created the Baytown Police Advisory Committee which shall consist of nine(9) members. The committee should be composed of a cross-section of the community. Council will endeavor to ensure that minority groups will be represented in proportion to their citywide percentage representation. suggestions, and recommendations to the City Council on police outreach, community policing, officer training, and policies and procedures to ensure best practices are in place and operational to create a community of trust. C. Appointments. I_ Terms. Members of the Baytown Police Advisory Committee shall be appointed by the City Council for staggered two-year terms, commencing on October 1. 2. Appointments. Each member of the City Council shall make one appointment to serve on the Baytown Police Advisory Committee.The Chief of Police shall make two appointments to serve on the Baytown Police Advisory Committee, one of which shall be an individual who is a licensed peace officer and mental health professional. All appointments are subject to Council's approval, and such appointees serve at the pleasure of the City Council. 3. Initial appointments. For the initial appointments,five(5)members will serve a two-year term,and four(4)members will serve a one-year term. The length of terms of the initial members will be determined by the casting of lots. 4. Vacancies. If vacancies occur, such vacancies shall be filled in the same manner as original appointments, except such terms shall only be for the remainder of the unexpired term. 5. Qualifications. The members of this committee shall be residents of the city, except for the Mayor's initial appointment, who may reside in the City's extraterritorial jurisdiction. Each member after appointed shall participate in one police education program or activity during his/her term. d. Meetings. All meetings of the Committee shall be open to the public. C. Powers and duties. The Baytown Police Advisory Committee shall hold such public forums to receive input from diverse community groups to enhance understanding through communication and education,to improve and maintain the public trust of the Baytown Police Department, and to further the purpose of the Committee. f Reports. The Committee shall prepare and present quarterly reports to the City Council. Section 2: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown,Texas. 2 INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown this the 91h day of May, 2024.
