A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY AUTHORIZING PAYMENT OF FIFTY-TWO THOUSAND ONE HUNDRED
NINE AND 87/100 DOLLARS (S52,109.87)TO CUMMINS,INC.FOR GENERATOR
REPAIR SERVICES AT THE BAYTOWN AREA WATER AUTHORITY FRITZ LANHAM
WATER TREATMENT PLANT,THROUGH THE SOURCEWELL COOPERATIVE
PURCHASING CONTRACT;MAKING OTHER PROVISIONS RELATED THERETO;AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown and the Baytown Area Water Authority ("BAWA")have entered into
an Interlocal Agreement whereinthe City and BAWA agree that the City will provide administrative functions,
including but not limited to, aspects of procurement, as authorized by law;
WHEREAS, the City of Baytown is a member of cooperative purchasing programs established under
Sections 271.082 and 271.083 of the Texas Local Government Code;and
WHEREAS, the Sourcewell Cooperative Purchasing Program is such a program, allowing government
entitiesto purchase productsand/or services in an efficient,cost effective,and competitiveprocurement method;
and
WHEREAS, pursuant to the Interlocal Agreement between the City and BAWA, BAWA, in making a
purchase under a state contract through such cooperative purchasing program,satisfies state law requiring
government entities to seek competitive bids for the purchase of the item; NOW THEREFORE,
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY:
Section 1:That the Baytown Area Water Authority hereby authorizes the payment of FIFTY-TWO
THOUSAND ONE HUNDRED NINE AND 87/100 DOLLARS ($52,109.87)to Cummins,Inc. for generator
repair services at the Fritz Lanham Water Treatment Plant,tlirough the Sourcewell Cooperative Purchasing
Contract.
Section 2:That the General Manager is hereby granted general authority to approve any change
order involvinga decreaseoran increaseincostsof FIFTYTHOUSANDAND NO/100 DOLLARS($50,000.00)
or less,providedthat the originalcontractprice may not be increasedby more than twenty-five percent (25%)or
decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease.
Section 3: This resolution shall take effect immediately from and after its passage by the Board of
Directors of the Baytown Area Water Authority.
