2024 03 28 WS Minutes MINUTES OF THE REGULAR WORK SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN March 28, 2024 The City Council of the City of Baytown, Texas, met in a Regular Work Session on Thursday, February 8,2024, at 5:30 P.M. in the Team Room of the Community Center at 2407 Market Street, Baytown, Texas, with the following in attendance: Laura Alvarado Mayor Pro Tern Sarah Graham Council Member Kenrick Griffith Council Member James Franco Council Member Jacob Powell Council Member Mike Lester Council Member Brandon Capetillo Mayor Jason Reynolds City Manager Scott Lemond City Attorney Gabriella Gonzales Open Govern John Stringer Sergeant at Arms Mayor Brandon Capetillo convened the February 22, 2024 City Council Regular Work Session with a quorum present at 5:31 P.M. All members were present. 1. CITIZEN COMMENT a. Marga Matthews, 606 East Republic Avenue, commented, "First, I want to thank you all for taking this into consideration for hopefully an amendment to this ordinance. I'm just going to go quick since you said I only have a minute. Okay. So, taxpayers,people move to areas that have no HOAs because of the fact that they don't want to be hounded constantly on different things. Timeframes,please consider timeframes where people can park,unload, and drop their passengers off because there are a lot of incidents in which people do this on occasion. Beautification, I know there's beautification in place here and if you can just look around in the neighborhoods and see which people purposely park in front of their yards and see how they beautify their homes.Usually, people who beautify their area of land do not do this on purpose." b. James Kilburn, 5001 Ashwood Drive,commented, "Folks, I've looked at this ordinance,as is written,and it looks like it's there for three purposes. One is to protect property values,to protect the aesthetics of the neighborhood, and to lessen the environmental impact of vehicles being parked in the yard. The ordinance also applies to all licensed and inspected operable motor vehi- cles. If I've got a vehicle that's not licensed, it looks like this would not apply to it being in my front yard. I don't understand why if it is for environmental purposes, I noticed this meeting is listed as being held by the Department of Health. Why is it okay environmentally if my vehicle drips oil in the backyard and not the front yard? It's still an environmental concern. I'd like the ability to be able to pull my vehicle into the yard and wash it. You don't want it in the storm drains." c. Marie Drenowski, 4705 Burning Tree. Without HOAs, we rely on the city and the city ordinances to preserve and maintain the aesthetics of our neighborhoods and to also maintain the value of our homes. Without the ordinances you help to enforce them, our neighborhoods will decline in appearance and value. The photos you have seen are there. The ordinance is needed to help us preserve the aesthetics and home values in our neighborhoods. Could the problem be with the ordinance being enforced? Could it be you're trying to fit the whole town into the same mold? Could it be some common sense is needed when enforcing the ordinances?Is the violation ongoing or is the regular basis or time?"(Exhibit A) 2. DISCUSSIONS a. Discuss the yard parking ordinance. Director of Health Tony Gary presented the City Council with a presentation discussing the Front Yard Parking Policy and highlighted a timeline of when the parking ordinance was created and when the ordinance changed from proactive(city staff looks for the compliant)to compliant based. Mr. Gary also discussed the Community Feedback which detailed suggested improvements with pros and cons along with Staff recommendations. (Exhibit B) Mayor Capetillo advised Council of the previous Councils perspective from 2009. During that time there were a multitude of citizens that were coming before Council, either through email or attending the Council meeting in person. There were perpetual yard parkers. The Council created an ordinance to prevent the decay and the overall aesthetics of the neighborhoods. The outcome was the yard parking ordinance was meant to be complaint-oriented. Through the years the ordi- nance was amended. Mayor Capetillo reiterated the City needs an ordinance that is enforceable, but doesn't want the city staff to gauge the compliant. The City is seeking voluntary compliance from the citizens and don't want to issues citations. The purpose of the ordinance is to preserve the essence of the neighborhoods throughout the city. Council Members expressed their opinions of the yard parking ordinance, along with requesting clarification of the process when citizens receive notification of violations, and the inconsistency within the ordinance. After a lengthy discussion, Sabrina Martin, Assistant to the City Manager presented a recap of Councils suggested changes to the ordinance. The recap includes: • Revisit Front Yard Parking Ordinance: o Complaint driven ordinance officially passed by council o Revisit the actual reasons why we have the ordinance; clear up any inconsistencies • Review a possible ordinance that addresses parking on commercial property and vacant lots • Review and educate what surfaces are allowed for parking • Review development regulations for future parking • Revisit simplifying the notice letters; recommended ideas are: o Adding"This is not a citation"at the top of the letter o Simplifying the verbiage so it's easier to understand City Council Regular Work Session Minutes March 28,2024 Page 3 of 3 • Communication blast sent out to the community for education about the ordinance • Review all court citations being sent via certified letters 3.
