AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE PAYMENT OF FIFTY-ONE THOUSAND ONE
HUNDRED THIRTY-THREE AND 50 100 DOLLARS ($51,133.50) TO MPH
INDUSTRIES, INC. THROUGH A COOPERATIVE PURCHASING
AGREEMENT WITH TARRANT COUNTY CONTRACT#2022-200,FOR THE
PURCHASE OF TWENTY-TWO (22) BEE-III STANDARD RADAR WITH
RELATED EQUIPMENT FOR THE POLICE DEPARTMENT; MAKING
OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS,the City desires to purchase the twenty-two(22)BEE-III Standard Radars and
related equipment for the Police Department through its Interlocal Agreement for cooperative
purchasing with Tarrant County from MPH Industries, Inc.; and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the
bids received by Tarrant County; and
WHEREAS, Tarrant County has taken bids and entered into a contract with MPH
Industries, Inc. for standard radars and related equipment; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the
payment of FIFTY-ONE THOUSAND ONE HUNDRED THIRTY-THREE AND 501100
DOLLARS ($51,133.50) to MPH Industries, Inc., through a cooperative purchasing agreement
with Tarrant County, for the purchase of twenty-two (22) BEE-III radars with related equipment
for the Police Department.
Section 2: That pursuant to the provisions of Texas Local Government Code
Annotated §252.048, the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO'100
DOLLARS ($50,000.00) or less, provided that the original contract price specified in Section 1
may not be increased by more than twenty-five percent (250,o) or decreased by more than twenty-
five percent(25%) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
