AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING PAYMENT NOT TO EXCEED ONE-HUNDRED SEVENTY-SEVEN
THOUSAND, TWO-HUNDRED, NINETY-FOUR AND 23100 DOLLARS
($177,294.23) TO LANSDOWNE-MOODY, INC, FOR ONE KUBOTA M5-1 I IHDC-1
OUTFITTED WITH AN 88"RIGHT-HAND INTERSTATER FLAIL, AND ONE
REPLACEMENT RIGHT-HAND FLAIL FOR USE ON AN EXISTING MOWER FOR
THE PARKS AND RECREATION DEPARTMENT THROUGH SOURCEWELL
COOPERATIVE PURCHASING PROGRAM; MAKING OTHER PROVISIONS
RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement or
membership for cooperative purchasing with Sourcewell Cooperative Purchasing Program (Sourcewell);
and
WHEREAS, Sourcewell is such a program, allowing municipalities to purchase products and/or
services in an efficient, cost effective, and competitive procurement method;and
WHEREAS, the City of Baytown in making a purchase under a state contract through such
cooperative purchasing program satisfies state law requiring municipalities to seek competitive bids for the
purchase of the item; NOW,THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment
to Lansdowne-Moody, Inc. in an amount not to exceed ONE-HUNDRED SEVENTY-SEVEN
THOUSAND, TWO-HUNDRED, NINETY-FOUR AND 231100 DOLLARS ($177,294.23) for one
Kubota M5-1 I IHDC-1 outfitted with an 88"right-hand interstater flail, and one replacement right-hand
flail for use on an existing mower for the Parks and Recreation Department through Sourcewell Cooperative
Purchasing Program.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated§252.048,
the City Manager is hereby granted general authority to approve any change order involving a decrease or
an increase in costs of FIFTY THOUSAND AND NO 100 DOLLARS ($50,000.00) or less, provided that
the original contract price may not be increased by more than twenty-five percent (251 o) or decreased by
more than twenty-five percent(25%)without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
