Ordinance No. 15,740 ORDINANCE NO. 15,740 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT NOT TO EXCEED ONE-HUNDRED SEVENTY-SEVEN THOUSAND, TWO-HUNDRED, NINETY-FOUR AND 23100 DOLLARS ($177,294.23) TO LANSDOWNE-MOODY, INC, FOR ONE KUBOTA M5-1 I IHDC-1 OUTFITTED WITH AN 88"RIGHT-HAND INTERSTATER FLAIL, AND ONE REPLACEMENT RIGHT-HAND FLAIL FOR USE ON AN EXISTING MOWER FOR THE PARKS AND RECREATION DEPARTMENT THROUGH SOURCEWELL COOPERATIVE PURCHASING PROGRAM; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement or membership for cooperative purchasing with Sourcewell Cooperative Purchasing Program (Sourcewell); and WHEREAS, Sourcewell is such a program, allowing municipalities to purchase products and/or services in an efficient, cost effective, and competitive procurement method;and WHEREAS, the City of Baytown in making a purchase under a state contract through such cooperative purchasing program satisfies state law requiring municipalities to seek competitive bids for the purchase of the item; NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment to Lansdowne-Moody, Inc. in an amount not to exceed ONE-HUNDRED SEVENTY-SEVEN THOUSAND, TWO-HUNDRED, NINETY-FOUR AND 231100 DOLLARS ($177,294.23) for one Kubota M5-1 I IHDC-1 outfitted with an 88"right-hand interstater flail, and one replacement right-hand flail for use on an existing mower for the Parks and Recreation Department through Sourcewell Cooperative Purchasing Program. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated§252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO 100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (251 o) or decreased by more than twenty-five percent(25%)without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
