Ordinance No. 15,736 ORDINANCE NO. 15,736 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AWARDING AN ANNUAL TRAFFIC MARKING STRIPING PRODUCTS CONTRACT WITH TRANTEX TRANSPORTATION PRODUCTS OF TEXAS, INC., USING THE LOCAL GOVERNMENT PURCHASING COOPERATIVE (BUY BOARD)CONTRACT#703-23; AUTHORIZING PAYMENT NOT TO EXCEED ONE- HUNDRED,TEN THOUSAND AND 00 100 DOLLARS ($110,000.00),TO TRANTEX TRANSPORTATION PRODUCTS OF TEXAS,INC.; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for cooperative purchasing with the Local Government Purchasing Cooperative(Buy Board); and WHEREAS, the Buy Board Program is such a program, allowing municipalities to purchase products and/or services in an efficient,cost effective,and competitive procurement method; and WHEREAS, the City of Baytown in making a purchase under a state contract through such cooperative purchasing program satisfies state law requiring municipalities to seek competitive bids for the purchase of the item; NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment to Trantex Transportation Products of Texas, Inc in an amount not to exceed ONE-HUNDRED, TEN THOUSAND AND 00/100 DOLLARS($110,000.00),for an Annual Traffic Marking Striping Products Contract through Buy Board Contract#703-23. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated§ 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND 00 100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (251 o) or decreased by more than twenty-five percent(250'o)without the consent of the contractor to such decrease.
