AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
APPROVING THE ANNUAL LIQUID HYDROCHLORIC ACID (15%) CONTRACT
BETWEEN THE BAYTOWN AREA WATER AUTHORITY AND BRENNTAG
SOUTHWEST, INC.; AUTHORIZING PAYMENT TO BRENNTAG SOUTHWEST,
INC. IN AN AMOUNT NOT TO EXCEED EIGHTEEN-THOUSAND, TWO-
HUNDRED, FORTY-ONE AND 00:100 DOLLARS ($18,241.00); AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the Board of Directors of the Baytown Area Water Authority advertised for bids for
the Annual Liquid Hydrochloric Acid (15%) Contract to be opened on Wednesday, December 20, 2023,
at 10:00 a.m.; and
WHEREAS, notice to bidders as to the time and place,when and where the contract would be let
was published in accordance with law; and
WHEREAS, all bids were opened and publicly read on Wednesday, December 20, 2023,at 10:00
a.m.,as per published notice to bidders; and
WHEREAS, Brenntag Southwest, Inc. was the lowest bidder at EIGHTEEN-THOUSAND,
TWO-HUNDRED, FORTY-ONE AND 00/100 DOLLARS ($18,241.00); and
WHEREAS, on February 21, 2024,the Board of Directors of the Baytown Area Water Authority
accepted the bid of Brenntag Southwest, Inc., for the Annual Liquid Hydrochloric Acid (15%) Contract;
and
WHEREAS, the legislation creating the Baytown Area Water Authority ("BAWA") requires that
the City Council of the City of Baytown approve contracts entered into by BAWA; and
WHEREAS,the City Council of the City of Baytown believes that such contract is desirable, fair,
and advantageous, for the performance of the BAWA's rights and powers; NOW THEREFORE
BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby approves the
Annual Liquid Hydrochloric Acid (15%) Contract between the Baytown Area Water Authority and
Brenntag Southwest, Inc. in the amount of EIGHTEEN-THOUSAND, TWO-HUNDRED, FORTY-ONE
AND 00/100 DOLLARS ($18,241.00).
Section 2: That the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of FIFTY THOUSAND DOLLARS ($50,000.00) or
less, provided that the original contract price specified in Section I hereof may not be increased by more
than twenty-five percent(25%) or decreased by more than twenty-five percent(25%) without the consent
of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
