Ordinance No. 15,730 ORDINANCE NO. 15,730 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING THE ANNUAL LIQUID CATIONIC POLYMER CONTRACT BETWEEN THE BAYTOWN AREA WATER AUTHORITY AND POLYDYNE, INC.; AUTHORIZING PAYMENT TO POLYDYNE, INC. IN AN AMOUNT NOT TO EXCEED TWO-HUNDRED, SIX THOUSAND, FIVE-HUNDRED, SIXTY-TWO AND 50/100 DOLLARS ($206,562.50); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the Board of Directors of the Baytown Area Water Authority advertised for bids for the Annual Liquid Cationic Polymer Contract to be opened on Wednesday, December 20, 2023, at 10:00 a.m.; and WHEREAS, notice to bidders as to the time and place,when and where the contract would be let was published in accordance with law; and WHEREAS, all bids were opened and publicly read on Wednesday, December 20, 2023, at 10:00 a.m.,as per published notice to bidders; and WHEREAS, Polydyne, Inc. was the lowest bidder at TWO-HUNDRED, SIX THOUSAND, FIVE-HUNDRED, SIXTY-TWO AND 50/100 DOLLARS ($206,562.50); and WHEREAS, on February 21, 2024, the Board of Directors of the Baytown Area Water Authority accepted the bid of Polydyne, Inc., for the Annual Liquid Cationic Polymer Contract; and WHEREAS, the legislation creating the Baytown Area Water Authority("BAWA") requires that the City Council of the City of Baytown approve contracts entered into by BAWA;and WHEREAS,the City Council of the City of Baytown believes that such contract is desirable, fair, and advantageous, for the performance of the BAWA's rights and powers; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby approves the Annual Liquid Cationic Polymer Contract between the Baytown Area Water Authority and Polydyne,Inc. in the amount of TWO-HUNDRED, SIX THOUSAND, FIVE-HUNDRED, SIXTY-TWO AND 50 100 DOLLARS ($206,562.50). Section 2: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND DOLLARS ($50,000.00) or less, provided that the original contract price specified in Section 1 hereof may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent(25%) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
