Ordinance No. 15,727 ORDINANCE NO. 15,727 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING THE ANNUAL LIQUID FERRIC CHLORIDE (40°o) CONTRACT BETWEEN THE BAYTOWN AREA WATER AUTHORITY AND PVS TECHNOLOGIES, INC.; AUTHORIZING PAYMENT TO PVS TECHNOLOGIES, INC. IN AN AMOUNT NOT TO EXCEED ONE-MILLION, FIVE-HUNDRED, TWELVE THOUSAND AND 00/100 DOLLARS ($1,512,000.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the Board of Directors of the Baytown Area Water Authority advertised for bids for the Annual Liquid Ferric Chloride (40°o) Contract to be opened on Wednesday, December 20, 2023, at 10:00 a.m.; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published in accordance with law; and WHEREAS, all bids were opened and publicly read on Wednesday, December 20, 2023, at 10:00 a.m.,as per published notice to bidders; and WHEREAS, PVS Technologies, Inc. was the lowest bidder at ONE-MILLION, FIVE- HUNDRED,TWELVE THOUSAND AND 00.100 DOLLARS ($1,512,000.00); and WHEREAS, on February 21, 2024, the Board of Directors of the Baytown Area Water Authority accepted the bid of PVS Technologies, Inc.,for the Annual Liquid Ferric Chloride(40%) Contract; and WHEREAS, the legislation creating the Baytown Area Water Authority ("BAWA") requires that the City Council of the City of Baytown approve contracts entered into by BAWA; and WHEREAS, the City Council of the City of Baytown believes that such contract is desirable, fair, and advantageous, for the performance of the BAWA's rights and powers; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby approves the Annual Liquid Ferric Chloride (40%) Contract between the Baytown Area Water Authority and PVS Technologies, Inc. in the amount of ONE-MILLION, FIVE-HUNDRED, TWELVE THOUSAND AND 00/100 DOLLARS ($1,512,000.00). Section 2: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND DOLLARS ($50,000.00) or less, provided that the original contract price specified in Section 1 hereof may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%)without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
