CITY COUNCIL OF THE CITY OF BAYTOWN
December 14, 2023
The City Council of the City of Baytown, Texas, met in a Regular Work Session on Thursday,
December 14,2023, at 4:04 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market
Street, Baytown, Texas, with the following in attendance:

Mayor Brandon Capetillo convened the December 14, 2023 City Council Regular Work Session
with a quorum present at 4:04 P.M. All members were present with the exception of Council
Member Sarah Graham. Ms. Graham arrived during the Executive Session.
1. CITIZEN COMMENT
Mayor Capetillo announced no one signed up to speak.
2. DISCUSSIONS
a. Discussion regarding the City's rate structure for sewer services, including the sewer
rate cap.
City Manager Jason Reynolds advised Council through discussions, the Mayor had asked that we
bring this item before the city council to ask staff to move forward with bringing a comprehensive
review of the rate structures so that the Council can consider rates in the near future due to some
things that have been heard throughout the summer with the removal of the sewer cap last year.
Mayor Capetillo commented, "I'm sure like other council members, we've had at least one citizen
come to speak with us,at least about her particular water bill. I believe there's probably a multitude
of factors. So, it seems like for people who were impacted, it could be multiple reasons. I would
like Staff to explore ways that we can, one, understand what took place and then if there's any
options including setting a sewer cap or adjusting it in some form or fashion. I believe that was
probably just one of those unintended situations and then you top that with a very dry summer and
so it just snowballed from the August and September water bills that our citizens received.

I appreciate staff and I know that they've looked into, individually the issues that may have been
forwarded to them. I want to really look holistically as a council and see what options may be
available to go and kind of reduce the impact of some of the previous decisions".
Council Member Griffith asked, "What is the overall water and sewer output?"
City Manager Jason Reynold advised Council that Staff didn't prepare specific data for the rates.
We plan to bring this item back to a future meeting to have a deeper discussion which then would
include specific data.
3. EXECUTIVE SESSION
a. Recess into and conduct an executive session pursuant to Texas Government Code,
Section 551.074 to deliberate the annual performance evaluation and duties of the City Man-
ager.
b. Recess into and conduct an executive session pursuant to Texas Government Code,
Section 551.074 to deliberate the annual performance evaluation and duties of the Municipal
Court Judge.
C. Recess into and conduct an executive session pursuant to Section 551.071 of the Texas
Government Code to seek the advice of the City's attorneys regarding pending or contem-
plated litigation.
d. Recess into and conduct an executive session pursuant to Texas Government Code
Sections 551.071, 551.072, and 551.087 to seek the advice of the City's attorneys; deliberate
the purchase, exchange, lease, or value of real property; and/or deliberate regarding eco-
nomic development negotiations.
At 4:10 P.M., Mayor Capetillo recessed and convened into an Executive Session pursuant to:
1) Section 551.074 to deliberate the annual performance evaluation and duties of the City
Manager.
2) Section 551.074 to deliberate the annual performance evaluation and duties of the Munici-
pal Court Judge.
3) Section 551.071 of the Texas Government Code to seek the advice of the City's attorneys
regarding pending or contemplated litigation.
4) Sections 551.071, 551.072, and 551.087 to seek the advice of the City's attorneys; delib-
erate the purchase, exchange, lease, or value of real property; and/or deliberate regarding
economic development negotiations.
At 6:35 P.M., Mayor Pro Tern Mike Lester reconvened the meeting and announced that, in
accordance with Section 551.102 of the Texas Government Code, no action was taken in the Ex-
ecutive Session.

Mayor Pro Tern Mike Lester recessed the Work Session at 6:35 P.M. and reconvened with the
regular Council meeting.
4. ADJOURN
Mayor Capteillo reconvened the executive Work Session at 8:08 P.M and adjourned the December
14, 2023, City Council Regular Work Session at 8:08 P.M.
