All members were present with the exception of the absence of Council Member Laura Alvarado, Council Member Sarah Graham and Council Member Heather Betancourth who were absent. The Pledge of Allegiance, Texas Pledge, and Invocation were led by Council Member Powell. 1. ELECTION CANVASS a. Canvass the returns of the City of Baytown's November 7, 2023, General Election. Mayor Capetillo and City Council conducted a tabulation on the total votes each District No. Four (4) candidate received. Mayor Capetillo signed the Certification of Runoff Candidates for Council Member District No. Four(4). b. Consider an ordinance calling for the City of Baytown Runoff Election to be held on December 9,2023, for the purpose of electing a Council Member for District No. Four (4). CITIZEN COMMENTS Mayor Capetillo announced no citizen had signed up to speak on the Citizen Comments item. 4. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Recognize City of Baytown Employees for their Years of Service. Recognize the Youth Leadership Academy participants. Sabrina Martina, Assistant to the City Manager, presented the item and recognized of all the participants of the Youth Leadership Academy. 5. PROPOSED ORDINANCES a. Consider the first reading of an ordinance for the proposed annexation of approximately an 54.589 acre tract of land out of Restricted Reserve"A" Blk 1 of the Replat of Restricted Reserve "A" of Cedar Crossing Phase II Subdivision, herein described tract being out of the residue of that called 102.12 acre tract, save and except a 14.229 acre tract conveyed to Cedar Crossing,situated in the John Steele Survey,Abstract No.227,Chambers County, Texas, and all property situated in Industrial District No. 3 required for the described annexation. Director of Planning and Development Services Martin Scribner presented the item to Council. He stated they are still in the process of trying to resolve this so it does not complete the annexation. The second reading will come before City Council in December. Consider an ordinance authorizing the automatic yearly price adjustment to the base rate for services of 6.9% for the second year of a five-year contract for the Annual Residen- tial Solid Waste Collection,Disposal,and Recycling Services Contract with Best Trash,LLC. Public Works and Engineering Director Frank Simoneaux presented the item to Council. This contracted began last year and is a 5-year contract that is renewed annually. This contract allows for a CPI increase as specified by the Bureau of Labor Statistics. The CPI is capped at 20% over the life of the contract. Mr. Simoneaux stated the CPI for this year is 6.90 o and will present some proposed rate increases and changes in the future. Mayor Brandon Capetillo added a comment stating added that Best Trash is fast and does a fine job but has heard from citizens the trash cans are not holding up. Mr. Simoneaux stated the public can contact Public Works and they can be switched out for new ones. Consider a resolution amending Resolution No. 2861, approved by the City Council of the City of Baytown,Texas,on September 28,2023,to delete the requirement for a General Plan. City Attorney Scott Lemond presented the item to Council. Mr. Lemond stated the language in the original Resolution No. 2861 would be amended to remove a General Plan to be required for MUDS in the Extra Territorial Jurisdiction (ETJ). A motion was made by Council Member Jacob Powell and seconded by Council Member Kenrick Griffith to approve Resolution No. 2870, related to Item 6.a. MANAGER'S REPORT City Manager Jason Reynolds highlighted the Household Hazardous Waste Collection Day the proceeded to mention a reminder to register for the Christmas Parade. Mr. Reynolds also men- tioned the Holiday Hangout opening and also thanked all who participated in the Turkey Trot. He also thanked two of the City of Baytown medics who saved a K9s life. 10. COUNCIL 1lERIBER DISTRICT REPORT a. Receive a report from Council Member Jacob Powell regarding projects, programs and events in District No. 5. Council Member Jacob Powell recognized what a great event the Turkey Trot was and thanked Parks and Recreation for the event.
