AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING PAYMENT NOT TO EXCEED ONE HUNDRED TWENTY-THREE
THOUSAND TWO HUNDRED FIFTY-ONE AND NOI100 DOLLARS
($123,251.00), TO KRAFTSMAN, LP, FOR A BASKETBALL COURT PAVILION
FOR BARKULOO PARK, THROUGH THE LOCAL GOVERNMENT PURCHASING
COOPERATIVE (BUY BOARD); MAKING OTHER PROVISIONS RELATED
THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for
cooperative purchasing with the Local Government Purchasing Cooperative(Buy Board); and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids
received and the negotiated contract entered into by the Buy Board; and
WHEREAS, the Buy Board has taken bids and entered into a contract for a basketball court
pavilion from and with Kraftsman, LP; and
WHEREAS, the city desires to purchase a basketball court pavilion from Kraftsman for Barkuloo
Park. NOW, THEREFORE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment
to Kraftsman, LP. in an amount not to exceed ONE HUNDRED TWENTY-THREE THOUSAND TWO
HUNDRED FIFTY-ONE AND NOI100 DOLLARS ($123,251.00), for a basketball court pavilion for
Barkuloo Park through a cooperative purchasing agreement with the Local Government Purchasing
Cooperative.
Section 2: That the limitations on payment amount in this ordinance is not intend to prohibit the
additional payment to Kraftsman, LP for additional basketball court pavilion authorized in another
ordinance, unless expressly stated otherwise in a subsequent ordinance by the City Council of the City of
Baytown.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §252.048,
the City Manager is hereby granted general authority to approve any change order involving a decrease or
an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, provided that
the original contract price may not be increased by more than twenty-five percent (25%) or decreased by
more than twenty-five percent (25%) without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately froth and after its passage by the City
Council of the City of Baytown.
