Ordinance No. 15,670ORDINANCE NO.15,670 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A PROPERTY DEDICATION AGREEMENT WITH CHEVRON PHILLIPS CHEMICAL COMPANY;AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED THIRTY-FIVE THOUSAND AND NO/IOO DOLLARS ($35,000.00);MAKING OTHER PROVISIONS RELATED THERETO AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS,the City of Baytown,Texas (the "City")acquired that certain Special Warranty Deed dated December 20,2018,and recorded under Clerk's File No.RP-2018-569858,Official Public Records of Harris County,Texas (the "Original Deed"),granting the City approximately 81.589 acres of land in the George Ellis Sui*vey of Harris County,Texas (the "Property");and WHEREAS,the Original Deed provides that the City shall re-convey the Property described therein to the Grantor,Chevron Phillips Chemical Company LP ("CP Chem")if the property is no longer used for park and other municipal purposes and CP Chem has satisfied the following conditions: 1.CP Chem gives twelve (12)months prior written notice of its request for re-conveyance to the City Manager;and 2. CP Chem pays the City the fair market value of all improvements made to the Property by the City from and after the date of conveyance of the Original Deed,which such value will be determined by an appraisal obtained by CP Chem;and WHEREAS,CP Chem has satisfied all conditions set forth in the Original Deed for the re conveyance of the Property;NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown,Texas,hereby reconveys the Property to CP Chem. Section 1:That the City Council of the City of Baytown,Texas,hereby authorizes and directs the City Manager of the City of Baytown to execute an Assignment of Deed with CP Chem.A copy of said agreement is attached hereto, marked Exhibit "A,"and made a part hereof for all intents and purposes. Section 3:That the City Council of the City of Baytown,Texas,hereby authorizes and directs the City Manager of the City of Baytown to execute a Deed Without Warranty to CP Chem.A copy of said agreement is attached hereto,marked Exhibit "B,"and made a part hereof for all intents and purposes. Section 4;This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
