Ordinance No. 15,657ORDINANCENO.15,657ANORDINANCEOFTHECITYCOUNCILOFTHECITYOFBAYTOWN,TEXAS,AUTHORIZINGPAYMENTNOTTOEXCEEDTWOHUNDREDFIFTY-EIGHTTHOUSANDTWOHUNDREDFIFTYANDNO/IOODOLLARS(S25S,250.00),TOPROGRESSIVECOMMERCIALAQUATICS,INC.,FORPLASTERANDPLASTERREPAIRSERVICE,THROUGHTHELOCALGOVERNMENTPURCHASINGCOOPERATIVE{BUYBOARD);MAKINGOTHERPROVISIONSRELATEDTHERETO;ANDPROVIDINGFORTHEEFFECTIVEDATETHEREOF.WHEREAS, the City Council of the CityofBaytovvnhas approved an Interiocal Agreement forcooperative purchasing with the Local Government Purchasing Cooperative (Buy Board); andWHEREAS,pursuantto suchagreement,the City may makepurchasesbased upon the bidsreceivedand thenegotiatedcontractenteredinto by the Buy Board; andWHEREAS, the Buy Board hastakenbids andenteredinto a contract for plaster and plaster repairservicefrom and withProgressiveCommercialAquatics,incorporated.NOW,THEREFORE,BEITORDAINEDBYTHECITYCOUNCILOFTHECITYOFBAYTOWN,TEXAS:Section1: That the City Councilofthe CityofBaytownherebyauthorizesthepaymenttoProgressiveCommercialAquatics,Inc. in anamountnot toexceedTWOHUNDREDFIFTY-EIGHTTHOUSANDTWOHUNDREDFIFTY ANDNO/IOODOLLARS($258,250.00)forplasterandplasterrepair service through a cooperative purchasingagreementwith theLocalGovernmentPurchasingCooperative(BuyBoard).Section2: Thisordinanceshall take effectimmediatelyfrom andafteritspassageby the CityCounciloftheCityofBaytown.Section3: Thatpursuantto theprovisionsofTexasLocalGovernmentCodeAnnotated§252.048,the City Manager is hereby granted general authority to approve any change order involving a decrease oranincreasein costsofFIFTYTHOUSANDANDNO/IOODOLLARS($50,000.00)or less,providedthatthe original contract price may not beincreasedby more than twenty-five percent (25%) or decreased bymorethantwenty-fivepercent(25%)withouttheconsentofthecontractortosuchdecrease.INTRODUCED,READ and PASSED by theaffiiBaytownthis the14thdayofDecember,2023.ATtEST:ANGELAJACKSQNvCityClerkVEDASTOFORM:NDONCAPETILLOSCOTTLEMOhJD,CityAttorneyR:\Jamilah.Way\0Council\I2.14.2023\ordinances\PiratesBay\ProgressiveCommercialAquatics!nc..docxoftheCityof
