Ordinance No. 15,646ORDINANCENO.15,646ANORDINANCEOFTHECITYCOUNCILOFTHECITYOFBAYTOWN,TEXAS,AUTHORIZINGPAYMENTNOTTOEXCEEDONEHUNDREDTWENTY-EIGHTTHOUSANDFIVEHUNDREDTENNO/I00DOLLARS($128,510.00)TOTYLERTECHNOLOGIES,INC.,ENERGOVSOFTWAREMAINTENANCE,THROUGHACOOPERATIVEPURCHASINGAGREEMENTWITHTHESOURCEWELLCOOPERATIVEPURCHASINGPROGRAM;MAKINGOTHERPROVISIONSRELATEDTHERETO;ANDPROVIDINGFORTHEEFFECTIVEDATETHEREOF.WHEREAS, the City Councilofthe CityofBaytown has approved an Interlocal Agreement ormembership forcooperativepurchasing withSourcewcIICooperative Purchasing Program("Sourceweir');andWHEREAS, pursuant to such agreement or membership, the City may makepurchasesbased uponthe bidsreceivedand thenegotiatedcontractenteredinto bySourcewell;andWHEREAS, Sourcewell has taken bids and entered into a contract from and with TylerTechnologies, Inc. for Energov software maintenance. NOW, THEREFORE;BE ITORDAINEDBYTHECITYCOUNCILOFTHECITYOFBAYTOWN,TEXAS:Section I: That the City Councilofthe CityofBaytown hereby authorizes payment to TylerTechnologies,Inc. not toexceedONEHUNDREDTWENTY-EIGHTTHOUSANDFIVEHUNDREDTENNO/lOODOLLARS ($128,510.00) to Tyler Technologies, Inc., for Energov software maintenancethrough a cooperative purchasing agreement with the Sourcewell Cooperative Purchasing Program.Section2:This ordinance shall takeeffectimmediately from and after its passage by the CityCounciloftheCityofBaytown.Section3: That pursuant to theprovisionsofTexasLocalGovernmentCodeAnnotated§252.048,the City Manager is hereby granted general authority to approve any change order involving a decrease oran increase in costsofFIFTY THOUSAND ANDNO/100DOLLARS ($50,000.00) orless,provided thatthe original contract price may not be increased by more than twenty-five percent (25%) or decreased bymore thantwenty-fivepercent(25%) without theconsentofthecontractorto suchdecrease.INTRODUCED, READ and PASSED by the affirmative vote of the City Councilofthe CityofBaytownthis the14thdayofDecember2023.ATTEST:ANGELAJACKSVEDAS'DONON,CityClerkSC01TLEMOjND,CityAttorneyR:\Jamilah.Way\0CounciI\12.I4.2023\ordinances\TyIerTechnologies\TyIerTechnologyVH.docx
