Ordinance No. 15,631 ORDINANCE NO. 15,631 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, AUTHORIZING THE PAYMENT OF FORTY-SEVEN THOUSAND EIGHTY-ONE AND 93 100 DOLLARS ($47,081.93) TO LOWE'S PRO, FOR THE PURCHASE OF APPLIANCES FOR THE PUBLIC SAFETY BUILDING PROJECT (PHASE 2 ADMINISTRATION BUILDING M), THROUGH COOPERATIVE PURCHASING AGREEMENTS WITH OMNIA PARTNERS AND THE INTERLOCAL PURCHASING SYSTEM (TIPS), THROUGH REGION 4 EDUCATION SERVICE CENTER (ESC) CONTRACT #R192006; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the City Council of the City of Baytown has approved Interlocal Agreements for cooperative purchasing with Omnia Partners and the Interlocal Purchasing System(TIPS); and WHEREAS, pursuant to such agreements, the City may make purchases based upon the bids received by Omnia Partners and TIPS;and WHEREAS,Omnia Partners and TIPS have taken bids for the purchase of appliances for the Public Safety Building Project(Building M) from Lowe's Pro through Region 4 Education Service Center(ESC) Contract#R192006;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of FORTY-SEVEN THOUSAND EIGHTY-ONE AND 93/100 DOLLARS ($47,081.93) to Lowe's Pro,for the purchase of appliances for the Public Safety Building Project(Building M),through cooperative purchasing agreements with Omnia Partners and the Interlocal Purchasing System, through Region 4 Education Service Center(ESC)Contract#R192006. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated§252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO'100 DOLLARS ($50,000.00)or less, provided that the original contract price specified in Section 1 hereof may not be increased by more than twenty-five percent(25%) or decreased by more than twenty-five percent(254`o)without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
