AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING PAYMENT IN THE AMOUNT OF ONE HUNDRED SIXTY-SIX
THOUSAND FIVE HUNDRED EIGHTY-SEVEN AND 34./100 DOLLARS
($166,587.34) TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY
FOR THE ANNUAL WATER ASSESSMENT FEE FOR THE CITY'S FOUR
WASTEWATER TREATMENT PLANTS; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.

WHEREAS, the Texas Commission on Environmental Quality ("TCEQ") water assessment fees
fund a State program to assess the quality of the river basins of the State,which is in response to the Clean
Water Act; and
WHEREAS, Senate Bill 818 requires TCEQ to recover the reasonable cost of the assessment
program from wastewater treatment permit holders and water rights holders;and
WHEREAS, the fees for services to the water assessments are assessed annually and due October
31 of each year pursuant to Title 30, Chapter 305, Subchapter M of the Texas Administrative Code; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown,Texas,hereby authorizes payment in
the amount of ONE HUNDRED SIXTY-SIX THOUSAND FIVE HUNDRED EIGHTY-SEVEN AND
341100 DOLLARS ($166,587.34) to the Texas Commission on Environmental Quality for the annual fee
for the City's four(4)wastewater treatment plants.
Section 2: That the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in the amount authorized in Section 1 hereinabove of FIFTY
THOUSAND AND N0./100 DOLLARS($50,000.00)or less;however,the original contract price may not
be increased by more than twenty-five percent(25°o)or decreased by more than twenty-five percent(25%)
without the consent of the Texas Commission on Environmental Quality to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
