AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING PAYMENT NOT TO EXCEED EIGHTY-EIGHT THOUSAND NINE
HUNDRED SIX AND 75/100 DOLLARS ($88,906.75) TO CLIFFORD POWER
SYSTEMS, INC, FOR GENERATOR MAINTENANCE,THROUGH THE LOCAL
GOVERNMENT PURCHASING COOPERATIVE(BUY BOARD); MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.

WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for
cooperative purchasing with the Local Government Purchasing Cooperative(Buy Board); and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids
received and the negotiated contract entered into by the Buy Board; and
WHEREAS,the Buy Board has taken bids and entered into a contract for generator maintenance
from and with Clifford Power Systems, Inc.; NOW,THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That the City Council of the City of Baytown hereby authorizes the payment to Clifford
Power Systems, Inc. in an amount not to exceed EIGHTY-EIGHT THOUSAND NINE HUNDRED SIX
AND 75:100 DOLLARS ($88,906.75) for generator maintenance through a cooperative purchasing
agreement with the Local Government Purchasing Cooperative.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated Section
252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO:100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25%) or
decreased by more than twenty-five percent(2500 without the consent of the contractor to such Decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
