FROM THE EXTRATERRITORIAL JURISDICTION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, Section 42.102 of the Texas Local Government Code authorizes residents of areas within a municipality's extraterritorial jurisdiction ("ETJ") to file a petition for the area to be released from the ETJ; and WHEREAS, Section 42.104 requires, among other things, that release from the ETJ is to occur if more than fifty percent (500 o) of the registered voters of the area, or a majority in value of the holders of title of land in the area, sign the petition; and WHEREAS, Section 42.105 requires the City Clerk to verify the information set forth in the Petition; and WHEREAS,on September 1,2023,the City Clerk for the City of Baytown,Texas received the Petition attached hereto as Exhibit "A" to this Ordinance requesting release of the following tract from the City's ETJ: • 0 Riverside Street, Highlands, Texas 77562, a 42.07 Acre Tract located in the George White Survey, Abstract No. 82, Harris County, Texas HCAD # 0410380000025; and WHEREAS,the City Clerk has verified the information set forth in the Petition as required by Section 42.105; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true and such recitals are hereby approved and made a part of this ordinance for all purposes and are adopted as a part of the judgment and findings by the City Council of the City of Baytown,Texas. On September 1, 2023, Petitioner filed the Petition with the City Secretary/Clerk of the City of Baytown (the"City") and the City noted its receipt of the Petition. Petitioner had the authority to file the Petition as the owner of the majority in value of an area consisting of one or more parcels of land in a municipality's ETJ pursuant to Section 42.102(b) of the Texas Local Government Code. The Petition was signed by a majority in value of the holders of title of the land included in the Petition and all signature requirements have been satisfied pursuant to Sections 42.103-04 of the Texas Local Government Code. The Petition was filed with a description of the property (see Exhibit "A" attached), a depiction showing the location of the property is attached in Exhibit "B", and proof of ownership provided by Harris County Appraisal District in Exhibit "C" attached. Pursuant to Section 42.105(c), Texas Local Government Code, if the City receives this Petition and does not take action to release the property described by the Petition (the "Property"), the Property shall be released from the ETJ by operation of law by the later of (i) 45 days after the date the City receives the Petition (September 16, 2023) or (ii) the next meeting of the City's governing body that occurs after the 30th day after the date the City receives this petition (October 12, 2023).
