AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE INCREASE IN BASE RATE OF SERVICES OF
6.90 o AS NOTICED FROM BEST TRASH, L.L.C. FOR THE SECOND YEAR
OF A FIVE-YEAR CONTRACT FOR ANNUAL RESIDENTIAL SOLID
WASTE COLLECTION, DISPOSAL, AND RECYCLING SERVICES;
AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT
NOT TO EXCEED SIX MILLION FOUR HUNDRED FIFTY-SEVEN
THOUSAND FIVE HUNDRED SIXTEEN AND 80/100 DOLLARS
($6,457,516.80); MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes and directs
the City Manager to accept and the City Clerk to attest to the notice from Best Trash, L.L.C. of
their automatic yearly price adjustment of 6.9%on their base rate for services,based on the twelve-
month percent change as reported in the Consumer Price Index-All Urban Consumers, Series ID:
CUSROOOOSEHG02 Garbage and Trash Collection for the second year of a five-year contract for
the Annual Residential Solid Waste Collection,Disposal,and Recycling Services Contract. A copy
of the Renewal Letter exercising their right of automatic yearly price adjustment is attached and
incorporated herein as Exhibit"A"for all intents and purposes.
Section 2: That the City Council hereby authorizes payment to Best Trash, L.L.C., in an
amount not to exceed SIX MILLION FOUR HUNDRED FIFTY-SEVEN THOUSAND FIVE
HUNDRED SIXTEEN AND 80/100 DOLLARS ($6,457,516.80), in accordance with the increase
in base rates of said contract authorized in Section 1.
Section 3: That pursuant to the provisions of Texas Local Government Code
Annotated § 252.048,the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100
DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by
more than twenty-five percent(250 0)or decreased by more than twenty-five percent(25%)without
the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.

RE: Annual CPI Adjustment Letter for City of Baytown
Best Trash is pleased to be City of Baytown's solid waste collection contractor. We are committed to providing you with
the most professional and reliable services available.
A component of the Contract is for an automatic yearly price adjustment based on the most recently published CPI-U for
Garbage and Trash series ID CUSROOOOSEHGO2. The CPI-U data indicates an increase of 6.9%. The current rate of$24.10
will increase $1.66 to $25.76 per month per connection. The new rates will take effect the billing cycle of December
2023 and continue through November 2024.
