CC Resolution No. 2870 RESOLUTION NO. 2870 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING RESOLUTION 2861 TO DELETE THE REQUIREMENT OF A GENERAL PLAN; MAKING OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on September 28, 2023, the City Council for the City of Baytown, Texas passed Resolution No. 2861 consenting to the inclusion of 53.82 acres of land within the extraterritorial jurisdiction of the City of Baytown,Texas,into Chambers County Municipal Utility District No. 1 ("MUD No. 1"); and WHEREAS, Section 3.a, "General Plan and Land Use" of the Resolution provides: Section 3: In consideration of the City giving its consent for the creation of the District,the petitioners agree that the following additional conditions and terms will apply to the land within the District after its creation: a. General Plan and Land Use. The land within the District will be developed in accordance with the General Plan, which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes; and WHEREAS, the ordinances of the City of Baytown do not require a General Plan as a condition for the consent of annexation of land within the extraterritorial jurisdiction into MUD No. 1; and WHEREAS, this resolution will serve to remove the requirement for a General Plan as a condition for the consent of annexation of land within the extraterritorial jurisdiction into MUD No. 1 while all other terms and conditions of the Resolution shall remain in full force and effect; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true and such recitals are hereby approved and made a part of this ordinance for all purposes and are adopted as a part of the judgment and findings by the City Council of the City of Baytown,Texas. Section 2: That Resolution 2861 is hereby amended to delete Section 3.a, "General Plan and Land Use." Section 3: That all other terms and conditions of Resolution 2861 shall remain in full force and effect. Section 4: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
