Ordinance No. 15,633 ORDINANCE NO. 15,633 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT NOT TO EXCEED ONE HUNDRED THOUSAND NO'100 DOLLARS ($100,000.00) TO CLEAN EARTH ENVIRONMENTAL SOLUTIONS, INC, FOR TRANSPORT AND DISPOSAL OF HOUSEHOLD HAZARDOUS WASTE ITEMS,THROUGH A COOPERATIVE PURCHASING AGREEMENT WITH THE HOUSTON-GALVESTON AREA COUNCIL (H-GAC); MAKING OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for cooperative purchasing with the Houston-Galveston Area Council (H-GAC); and WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids received and the negotiated contract entered into by the H-GAC; and WHEREAS, the H-GAC has taken bids and entered into a contract for transport and disposal of household hazardous waste items from and with Clean Earth Environmental Solutions, Inc.; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment to Clean Earth Environmental Solutions, Inc. not to exceed ONE HUNDRED THOUSAND AND NO 100 DOLLARS ($100,000.00), for transport and disposal of household hazardous waste items through a cooperative purchasing agreement with the Houston-Galveston Area Council. Section 2: That pursuant to the provisions of the Texas Local Government Code Annotated Section 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NOI100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (250 o) or decreased by more than twenty-five percent(25%) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
