CC Resolution No. 2867 RESOLUTION NO. 2867 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING HR GREEN INC.'S RECOMMENDATIONS FOR BROADBAND EXPANSION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on March 9,2023,the City Council of the City of Baytown,Texas,passed Ordinance No. 15,3961 authorizing a Professional Services Agreement with HR Green, Inc. ("HR Green"), for the development of a Broadband Needs Assessment and Master Plan for the City of Baytown; and WHEREAS, on October 26, 2023, the City Council received HR Green's Assessment recommending a challenge to US Federal Communications ("FCC") maps to accurately reflect Baytown's broadband needs and aspirations; initiation of the Request for Expression of Interest ("RFET") process to address broadband issues and prepare for grants;pursuit of grants for areas within the City of Baytown with broadband issues; continuation of discussions with Digital Equity partners to define grant opportunities and coordinate the grant application process, creation of digital literacy programs, and work with local higher education to develop workforce development programs to train citizens for jobs in broadband related fields; development of plans for a City fiber ring that can be considered for grants; enhancing broadband in collaboration with service providers and aligning infrastructure with the City's planned projects and major developments; development of a clear chart outlining broadband improvement steps, with a defined ownership structure for task execution; tasking HR Green with preparing a proposal to define cell coverage and establishing a plan to engage cellular providers to enhance coverage within Baytown; development of guidelines for 5G/Small Cell reporting, emphasizing vendor-certified reports to verify compliance with FCC limits and safety standards; and creation of a Right-of-Way ("ROW") management plan to protect road segments at risk of running out of available ROW, particularly in areas with potential utility congestion, including telecommunications; and WHEREAS, the City Council believes that for municipal purposes, it is in the best interest of the City of Baytown to adopt a strategic roadmap for the advancement of broadband infrastructure in Baytown based on the recommendations; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council hereby finds that all matters and facts set forth in the recitals above are found to be true and correct. Section 2: That the City Council adopts a strategic roadmap for the advancement of broadband infrastructure in Baytown based on the recommendations, considering: • a challenge to FCC maps; • initiation of the RFEI process; • pursuit of grants for areas within the City of Baytown with broadband issues; • continuation of discussions with Digital Equity partners; • development of plans for a City fiber ring; • enhancing broadband in collaboration with service providers and aligning infrastructure with the City's planned projects and major developments; • development of a clear chart outlining broadband improvement steps; • tasking HR Green with preparing a proposal to define cell coverage and establishing a plan to engage cellular providers to enhance coverage within Baytown; • development of guidelines for 5G/Small Cell reporting; and • creation of a ROW management plan.
