A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, RENEWING THE BAYTOWN REVITALIZATION INCENTIVE
ZONE, A NEIGHBORHOOD EMPOWERMENT ZONE WITHIN A PORTION
OF THE CITY OF BAYTOWN; MAKING APPROPRIATE FINDINGS
RELATED THERETO; EXERCISING MUNICIPAL POWERS TO ESTABLISH
INCENTIVES WITHIN THE ZONE; ESTABLISHING THE EFFECTIVE AND
EXPIRATION DATES OF THE ZONE AND A MECHANISM FOR RENEWAL
OF THE ZONE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City Council of the City of Baytown, Texas, desires to create the proper
economic environment to induce the investment of private resources to promote both an increase
in economic development and the rehabilitation of affordable housing within the City; and
WHEREAS, the establishment of a neighborhood empowerment zone is an economic
development tool which the City Council believes will be effective in creating such economic
environment; and
WHEREAS, this economic development tool vests the City with various development
powers in the area which is designated as a neighborhood empowerment zone, including the
waiver of building permit fees and impact fees as well as the abatement of taxes; and
WHEREAS, the City Council hereby determines that the renewal of the neighborhood
empowerment zone covering part of the City of Baytown will promote both an increase in
economic development and the rehabilitation of affordable housing within such zone; and
WHEREAS, the City Council of the City of Baytown hereby finds that the neighborhood
empowerment zone to be renewed herein satisfies the requirements of Section 312.202 of the
Texas Tax Code, in that the area described hereinbelow:
1. substantially arrests or impairs the sound growth of the City and retards the
provision of housing in its present condition and use because of the presence of
a. a substantial number of deteriorating structures and/or
b. the deterioration of site or other improvements; and
2. is reasonably likely as a result of the neighborhood enterprise zone designation to
contribute to the retention or expansion of primary employment or to attract major
investment in the zone that would be a benefit to the property and that would
contribute to the economic development of the City; and
WHEREAS, the City Council of the City of Baytown lastly finds that renewal of the
neighborhood empowerment zone benefits and is for the public purpose of increasing the public
health, safety and welfare of persons in the City;NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That all matters and facts set forth in the recitals above are found to be true;
and are adopted as the findings of the City Council of the City of Baytown, Texas. All required
findings pursuant to Chapter 378 of the Texas Local Government Code necessary to establish the
neighborhood empowerment zone created herein are hereby declared to have been made and
adopted as findings of the City Council of the City of Baytown.
Section 2: That the City Council of the City of Baytown, Texas, hereby renews the
neighborhood empowerment zone, known as the Baytown Revitalization Incentive Zone,
consisting of that area more particularly described in Exhibit "A," which is attached hereto and
incorporated herein for all intents and purposes.
Section 3: That the City Council authorizes the exercise of the following municipal
powers within the neighborhood empowerment zone created in Section 2 hereof for qualified
improvement projects in accordance with the Incentive Policy for the Baytown Revitalization
Incentive Zone adopted via ordinance on this date:
a. waiver of construction permit fees;
b. waiver of impact fees; and
c. refund of a portion of municipal ad valorem taxes paid on new eligible
improvements.
Section 4: The Baytown Revitalization Incentive Zone shall take effect on October 24,
2023, and shall expire on October 25, 2024; provided the zone may be renewed by the City for one
or more subsequent terms of no more than two years.
Section 5: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
