MINUTES OF THE REGULAR MEETING
OF THE BOARD OF DIRECTORS
OF THE BAYTOWN AREA WATER AUTHORITY
May 20, 1981
The Board of Directors of the Baytown Area Water Author-
ity, Harris County, Texas, met in regular session on Wednesday,
May 20, 1981 , in the Conference Room of the Baytown City Hall
with the following attendance :

The meeting was called to order and the following busi-
ness was transacted:

Board member Buenz moved for approval of the minutes;
Board member Hill seconded the motion. The vote follows :

Consider Certificate of Substantial Completion for Portion
of Work Performed by Angleton General Mechanical , Inc.
At the last Board meeting, the consultants had prepared
a Certificate of Substantial Completion which Mr. Lanham
executed for the section of line from the plant to a line
valve just south of IH-10. Since that time another section
of line has progressed to the point of substantial completion.
Substantial completion means that the line can be used for
the purpose intended, but that does not mean that the line
is finally complete or that all the final cleanup has been
completed. The line is in place, and it is delivering water.
Therefore, the engineers are recommending approval of the
Certificate of Substantial Completion for the section of
line from the valve south of IH-10 to the tie-in at Decker.
This means that the one-year warranty period begins .
The Board inquired if in the light of possible litigation
with this company if it would be prudent to issue Certificate
of Substantial Completion?
The City Attorney responded that the aspects that would
be considered a litigation are damage claims against Angleton

for the delay and whatever claims there may be for extra work;
therefore , there would be no reason for delay in issuance of
the certificate from a legal standpoint . By the issuance of
Certificate of Substantial Completion, no additional monies
will be expended.
Bob Parker, representative with Lockwood, Andrews and
Newnam, Inc. , explained that prior to the county closing a
portion of the project until Angleton got cleanup accomplished,
the engineers begun the process by which 32 to 42 percent of
the unit price for the lines was withheld on the basis that

the lines had not been tested, chlorinated or placed in
service. When the point is reached where all of the clean-
up work, testing and everything is completed, the engineers
are prepared to recommend that the final 32 to 41 percent
of that 100 percent unit price be paid. The ten ( 10%) percent
retainage, however, will not be paid until such time as the
Board approves the entire project . Angleton has requested
release of the retainage but the engineers have explained
that a precedent was set with BRH. The retainage on the
BRH section of line was not released until the project was
satisfactorily completed and until Harris County had accepted
the work.
The contractor is attempting to test a section of Lynch- •
burg-Cedar Bayou from Thompson to Wade Road. Assuming that
this section actually passes the test and is ready for use,
there is no way that BAWA could use the line to deliver water.
Therefore, this section of line will not be useful to BAWA,
and will not be useful even if the line is completed section
by section, valve to valve. The engineers will not recommend
substantial completion be issued until the line reaches a
point where water can actually be delivered to the city .
Board member Buenz moved to approve issuance of Certi-
ficate of Substantial Completion for the section of line
from the valve south of IH-10 to the tie-in at Decker.
Board member Hartman seconded the motion. The vote follows :

Consider Certificate of Substantial Completion for Work
Performed by Chisholm Trail Construction Company
Rick French, representative of Lockwood, Andrews and
Newnam, Inc . , explained that this Certificate of Substantial
Completion goes back to the period when the first section of
Angleton line was placed into service and water was pumped
through that line and then through the 12-inch line that goes
along IH-10 over to Garth Road. Since at that time , BAWA
engineers recommended that Certificate of Substantial Com-
pletion be issued on the water treatment plant as of April 9,
1981, excluding instrumentation. Everything at the treatment
plant will now have a certificate of substantial completion
with the exception of instrumentation.
Board member Buenz moved to approve Certificate of Sub-
stantial Completion to Chisholm Trail Construction Company
for the water treatment plant effective April 9, 1981 , with
exception of instrumentation; Board member Butrick seconded
the motion . The vote follows :

Hear Report from Lockwood, Andrews and Newnam, Inc.
Rick French explained that on the water treatment plant
there has been some problems with instrumentation due to the
fact the instruments were not used for several months and
also, there has been some lightning damage . Bristol , the
instrument supplier, has removed some of the instruments and
forwarded same to the factory. The estimate is that it will
be 3-4 weeks before the instruments will be repaired. There-
fore, by mid June, the plant should be operating completely
in an automatic mode.
In response to a question from the Board, Norman Dykes,
• Director of Public Works, explained that there have been times
when it was necessary to shut the plant down; however, only
for brief periods of time.
The engineers are looking at various possibilities for
providing more lightning protection and may be recommending
more lightning protection than what is presently installed.
Bob Parker with Lockwood, Andrews and Newnam, Inc.
explained that the condition of the Lynchburg Cedar Bayou
section of line remains somewhat the same. There is work in
progress with anywhere from 2-3 grout crews working on the
interior of the line. These crews are attempting to ready
the line for testing throughout the entire section. The
section from Thompson to Wade Road has been tested by Angleton,
although the consulting engineers have not inspected the line .
Angleton has experienced some leaks along that section of line
which they are attempting to repair . At the same time, Angle-
ton is working on the other end of the line. There is a section
near Exxon pipeline that has been inspected and is ready as far
as the engineers are concerned, but the line needs to go to
Garth Road before testing. Since last month Angleton is working
in two areas--the Exxon pipeline crossing and what is termed
the "Bayou" crossing to the west of Exxon pipeline. There have
been problems making the final tie-ins and making the final
welds within the casings at both locations. The only section
of line remaining incomplete are the tie-ins on either side
of the aerial crossing of Goose Creek. This is purposely
being done so that the line can be flushed in both directions
to Goose Creek. The work is progressing slowly.
In response to an inquiry from the Board, Mr. Parker
stated that the entire Angleton project was to have been
completed by September 1980.
The Board requested that the engineers encourage the
contractor to use the most innovative methods possible to
complete this job.
Mr . Parker explained that the new foreman was the one
responsible for use of gas to locate the leaks in the previous
section of line. Also, this foreman has deplored his personnel
• in several locations at the same time and has utilized a vactor
to extract mud from the San Jacinto and Exxon crossings which
would have taken several weeks if laborers with buckets were
utilized.
The consultants stated that they would make every effort
to encourage the contractor to utilize the most innovative
methods to complete the job.

The Board requested that the next regular meeting be
held at the BAWA plant.
There being no futher business to be transacted, the
motion was made and duly seconded to adjourn.
