1981 04 15 BAWA Minutes 10415-1 MINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY April 15, 1981 The Board of Directors of the Baytown Area Water Author- ity , Harris County, Texas, met in regular session on Wednesday, April 15, 1981 , in the Conference Room of the Baytown City Hall with the following attendance : Robert L. Gillette, President Peter R. Buenz, Secretary • Harry F. Hartman, Board Member Dr. Robert E . Hill , Board Member Absent : I . J. Butrick, Vice President The meeting was called to order and the following business was transacted: Minutes Board member Hill moved for approval of the minutes ; Board member Hartman seconded the motion . The vote follows : Ayes : Board member Buenz, Gillette, Hartman and Hill Nays : None Discuss Beginning of Warranty Period for Chisholm Trail Contract Rick French with Lockwood, Andrews and Newnam, Inc. explained that the general conditions of the specifications provide that when the project is substantially complete, the engineer will issue a certificate of substantial completion, and at that time the general warranty period which lasts for one year will begin. The definition of substantial completion is when the project can be used for its intended purposes by the owner. Baytown Area Water Authority moved into the admin- istration and chemical buildings and began utilizing portions of those buildings back in December. Specifically, the air conditioning and plumbing portions have been utilized and the subcontractors feel that their general warranty period began at that time. The intent at that time was to get the plant into operation in January or early February. Since that has not transpired, this has caused a real problem for Chisholm Trail . What the consulting engineers are recommending is that a certificate of substantial completion be given to Chisholm Trail on the exterior and structural portions of both buildings and heating/cooling and plumbing. No certificate of substantial completion would be given on the instrumentation systems . The • certificate of substantial completion would be dated effective January 1 , 1981 . Mr. Lanham stated that he felt this would be reasonable since Baytown Area Water Authority had begun to utilize the facilities in December. Board member Hartman moved to authorize the engineers to issue certificate of substantial completion to Chisholm Trail on the exterior and structural portion of both the 10415-2 Minutes of the BAWA Board - April 15, 1981 administration and chemical buildings and the heating/cooling and plumbing to be dated effective January 1 , 1981 . Board member Buenz seconded the motion. The vote follows : Ayes : Board members Buenz, Gillette, Hartman and Hill Nays : None Certificate of Substantial Completion - Angleton - Thompson Road Line Mr. Lanham mentioned that he had in his possession certi- ficate of substantial completion for the portion of the Angleton • line that is now in service and that he would sign same effec- tive April 8, 1981 . Hear Report from Lockwood, Andrews and Newnam, Inc. Bob Parker with Lockwood, Andrews and Newnam called the Board' s attention to a map which depicted portions of the line that have been completed, portions that the contractor has been attempting to pressure test and portions that need interior grouting. As of last Friday, the contractor began to attempt to pressure test the section of line from the valve south of Interstate 10 to the tie-in at Decker. What has happened the pressure has been up to 130 pounds, but never to the 160 pounds required which indicates there is still a high pressure leak. Forty-two (42%) percent are somewhat under construction , need repair or interior grouting. There are a couple of large gaps in the line. One is at Goose Creek and probably will be the last thing to be completed. Mr. Lanham reported that Angleton has made some personnel changes. A new superintendent is now in charge of construction and work is now in progress at more than one location at a time . Recess into Executive Session to Discuss Contemplated Litiga- tion The open meeting was recessed into executive session to discuss contemplated litigation . When the open meeting reconvened, President Gillette announced that no business had been transacted. Since there was no further business to be transacted, the meeting was adjourned. t") Peter R.
