BAWA Resolution No. 2023-14 RESOLUTION NO. 2023-14 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY RENEWING THE ANNUAL MECHANICAL SERVICES CONTRACT FOR MAINTENANCE AND REPAIRS AT WATER TREATMENT PLANTS FOR YEAR 2 WITH IPS PUMP SERVICES, INC.; AUTHORIZING PAYMENT BY THE BAYTOWN AREA WATER AUTHORITY FOR SUCH RENEWAL IN AN AMOUNT NOT TO EXCEED THREE HUNDRED THOUSAND AND NO1100 DOLLARS ($300,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Baytown Area Water Authority contracted with IPS Pump Services, Inc., for the Annual Mechanical Services Contract for maintenance and repairs at water treatment plants;and WHEREAS, the competitively bid Annual Mechanical Services Contract included an option by the parties to renew for additional one-year periods; and WHEREAS,such contract can now be renewed for an additional one-year term; and WHEREAS, IPS Pump Services, Inc., has indicated its willingness to renew the contract for an additional year under the same terms and conditions with a 4%Consumer Price Index increase; and WHEREAS, the Board has reviewed the market conditions and recommends renewal as being in the best interest of the Baytown Area Water Authority;NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY: Section 1: That subject to the approval of the City Council of the City of Baytown, TX, Board of Directors of the Baytown Area Water Authority hereby renews the Annual Mechanical Services Contract for maintenance and repairs at water treatment plants for Year 2 with IPS Pump Services, Inc., for an amount not to exceed THREE HUNDRED THOUSAND AND NO/100 DOLLARS($300,000.00),and authorizes payment thereof. Section 2: That the General Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NOI100 DOLLARS ($50,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent(25%) without the consent of the contractor to such decrease. Section 3: This resolution shall take effect immediately from and after its passage by the Baytown Area Water Authority.
