AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF BAYTOWN,
CHANGING THE ZONING DISTRICT CLASSIFICATION ON THE FOLLOWING
PROPERTY,BEING APPROXIMATELY 0.41 ACRES OF LAND,A COMBINATION
THE RESIDUE OF TRACT I AND TRACT I[ OF THE TRACTS DESCRIBED IN
HARRIS COUNTY CLERK'S FILE NUMBER H832975 AND MORE
PARTICULARLY DESCRIBED IN EXHIBIT A, FROM A GENERAL
COMMERCIAL (GC) ZONING DISTRICT TO A MIXED RESIDENTIAL AT LOW-
TO MEDIUM-DENSITIES(SF2)ZONING DISTRICT; PRESCRIBING A MAXIMUM
PENALTY OF TWO THOUSAND AND NO::100 DOLLARS ($2,000.00); PROVIDING
REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PROVIDING A
SEVERABILI[TY CLAUSE; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown Planning and Zoning Commission and the City Council, in
accordance with the Charter of the City of Baytown,state law,and the ordinances of the City of Baytown,
have given the required notices and have held public hearings regarding the rezoning of the property
described in this ordinance;and
WHEREAS, the City Council finds that this change in zoning district classification is consistent
with and furthers the policies and goals of the future land use plan, major thoroughfare plan, vision
statement,and the zoning ordinances of the City of Baytown;is compatible with existing and proposed uses
surrounding the subject land and is the appropriate district for the land use proposed; promotes the health,
safety,or general welfare of the City and includes the safe,orderly,and healthful development of the City;
facilitates the adequate provision of transportation, mobility, water, wastewater, stormwater and other
public services;there are changed conditions; the rezoning will not result in adverse impacts on the natural
environment, including, but not limited to, water, air, noise, stormwater quality,wildlife, vegetation, and
wetlands; and
WHEREAS, the City Council finds that it is in the public interest to change the zoning district
classification as specified in this ordinance;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the facts and recitations contained in the preamble of this ordinance are
hereby found and declared by the City Council of the City of Baytown,Texas,to be true and correct.
Section 2: That the zoning map of the City of Baytown is hereby amended by changing the
zoning classification from a General Commercial (GC)Zoning District to a Mixed Residential at Low-to-
Medium Densities(SF2)Zoning District on the following property:
Being approximately 0.41 acres of land, a combination the residue of Tract I and Tract II
of the Tracts described in Harris County Clerks File Number H832975,more particularly
described and depicted in Exhibit A,attached hereto.
Section 3: That the property description in Section 2 of this ordinance shall be construed as
including the area to the centerline of all adjacent streets and alleys.
Section 4: Any person who fails to comply with any provision of this ordinance shall be guilty
of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding TWO THOUSAND
AND N&100 DOLLARS($2,000.00). Each act of violation and each day upon which any such violation
shall occur shall constitute a separate offense. In addition to the penalty prescribed above, the City may
pursue other remedies such as abatement of nuisances, injunctive relief, administrative adjudication and
revocation of licenses or permits.
Section 5: All ordinances or parts of ordinances inconsistent with the terms of this ordinance
are hereby repealed; provided,however,that such repeal shall be only to the extent of such inconsistency,
and in all other respects, this ordinance shall be cumulative of other ordinances regulating and governing
the subject matter covered by this ordinance.
Section b: That the zoning ordinances of the City of Baytown, as amended, shall remain in
full force and effect,save and except as amended by this ordinance.
Section 7: That the terms and provisions of this ordinance are severable and are governed by
Chapter 1 of Baytown Code of Ordinances.
Section 8: This ordinance shall take effect from and after ten (10) days from its passage by
the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this
ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10)
days after passage of this ordinance.
