I TO JOINDER AGREEMENT AND AMENDMENT NO. 2 TO THE INTERLOCAL AGREEMENT BETWEEN HARRIS COUNTY SHERIFF'S OFFICE ("HARRIS COUNTY") AND THE HARRIS CENTER FOR MENTAL HEALTH AND IDD ("HARRIS CENTER"); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes Amendment No. 1 to Joinder Agreement and Amendment No. 2 to the Interlocal Agreement with Harris County and the Harris Center. A copy of said Contract Renewal Amendment No. I to Joinder Agreement and Amendment No.2 to the Interlocal Agreement is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. WHEREAS, the underlying Interlocal Agreement (ILA) between Harris County and The Harris Center expired on February 28, 2022. Thereafter, the same Parties in interest executed a new agreement dated August 23, 2022. The Baytown Police Department through Joinder Agreement No. 2 joined the original ILA prior to its expiration. WHEREAS, The Parties entered into a Joinder Agreement and Amendment No. 2 to ILA between the Harris County Sheriffs Office and The Harris Center("Agreement")on the 1"day of November 2021 for Mental Health Assessments through the Clinician and Officer Remote Evaluation. WHEREAS,the fully executed Joinder Agreement and Amendment No.2 was noted post execution to have an error in the body of the document. Specifically, 1) the preamble erroneously included the County as a Party to the Joinder Agreement; 2)the Joinder Agreement included signature lines for the County in error. It is the Parties' intention to correct those errors as stated hereunder through this Renewal Amendment No. 1. The Parties to this contract Renewal Amendment No. 1, acknowledge that the Joinder Agreement and Amendment No. 2 dated November 1, 2021, is hereby RENEWED for fiscal year 2022-2023 with the following additions or modifications unless such has been added by previous amendment. I. The preamble of the Joinder Agreement and Amendment No.2 is struck in its entirety and replaced as noted below: This Joinder Agreement and Amendment No.2("Joinder"and"Amendment No.2")to the original Interlocal Agreement ("Agreement") dated November 1, 2021, between the City of Baytown through its Baytown Police Department ("BPD") ("Peace Officer" or"Policing Agencies") and The Harris Center for Mental Health and IDD ("The Harris Center" or "Agency") a State designated Community Center and an Agency of the State of Texas and pursuant to the Interlocal Cooperation Act, Tex. Gov't Code Ann. §§ 791.001 —791.030. BPD and The Harris Center may each be referred to individually herein as a"Party,"or collectively as the"Parties." 2. The execution page is hereby amended by striking any signature blocks referencing the County or its Officer and leaving only the required signature blocks for the Baytown Police Department and The Harris Center. 3.
