Ordinance No. 8692 990909-18 ORDINANCE NO. 8692 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT WITH MID-GULF INDUSTRIAL, INC., FOR THE REPAIR AND/OR REPLACEMENT OF CHANNEL MARKERS AT BAYLAND PARK; AUTHORIZING CHANGE ORDER NO. #1 WITH MID-GULF.INDUSTRIAL, INC., FOR.DELETING..FROM THE SCOPE OF WORK THE LASHING OF NEW TIMBER PILES TO EXISTING PILES FOR ADDED STRENGTH; AUTHORIZING PAYMENT OF THE SUM OF SEVENTY-NINE THOUSAND THREE HUNDRED NINETY-SIX AND NO/100 DOLLARS ($79,396.00); MAKING OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE • EFFECTIVE DATE THEREOF. ************************************************************************************** WHEREAS,the City Council of the City of Baytown did authorize the City's Engineer to advertise for bids for the repair and/or replacement of channel markers at Bayland Park to be received September 1, 1999; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Texas Local Government Code Annotated § 252.041; and WHEREAS,all bids were opened and publicly read at City Hall at 1:30 p.m., September 1, 1999, as per published notice to bidders; and WHEREAS, the City Council of the City of Baytown desires to award the contract to Mid-Gulf Industrial, Inc., the lowest responsible bidder with a decreased scope of work, which removes the requirement to lash the new timber piles to the existing piles, for such requirement has been deemed by the City Engineer to be unnecessary and without affect to the life of the channel markers; and WHEREAS, Mid-Gulf Industrial, Inc., has agreed to Change Order No. 1 decreasing the scope of work;NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Mid-Gulf Industrial, Inc., for the repair and/or replacement of Channel Markers at Bayland Park according to the plans and specifications set forth by the City's Engineer for the sum of NINETY-ONE THOUSAND FIVE HUNDRED SEVENTEEN AND NO/100 DOLLARS ($91,517.00). The City Manager and the City Clerk of the City are hereby authorized and directed to execute and attest.to a contract with Mid-Gulf Industrial, Inc., for the above-described work, said contract containing the plans, specifications, and requirements of the City's Engineer and appropriate bond requirements in accordance with the provisions of Texas Government Code, Chapter 2253. Section 2: That the City Council does hereby authorize Change Order No. 1 with Mid-Gulf Industrial, Inc., for deleting from the scope of work the lashing of new timber piles to existing piles for added strength. A copy of said change order is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. 990909-18a Section 3: That the City Council of the City of Baytown hereby authorizes the payment of SEVENTY-NINE THOUSAND THREE HUNDRED NINETY-SIX AND NO/100 DOLLARS ($79,396.00) to Mid-Gulf Industrial, Inc. for the contract for the repair and/or replacement of channel markers at Bayland Park along with Change Order No. 1, removing from the scope of work the requirement to lash the new timber piles to the existing piles, for such requirement has been deemed by the City Engineer to be unnecessary and without affect to the life of the channel markers. Section 4: . That the administration is authorized to contract for utility adjustments, laboratory testing, and other professional services necessary to the operation and completion of the project. Section 5: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048,the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND NO/100 DOLLARS ($15,000.00)or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent(25%) or decreased by more than twenty-five percent(25%)without the consent of the contractor to such decrease. Section 6: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
