FCPEMSD Resolution No. 94RESOLUTION NO. 94 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT REQUESTING THE CITY OF BAYTOWN TO WAIVE THE REMAINING REIMBURSEMENT PAYMENTS FOR TWO (2) PIERCE VELOCITY PUMPER TRUCKS AND ENGINE 7 IN THE AMOUNT OF ONE MILLION FOUR HUNDRED TWENTY-EIGHT THOUSAND FIVE HUNDRED FOURTEEN AND NO! 100 DOLLARS ($1,428,514.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, in November 2021, the Baytown Fire Control, Prevention, and Emergency Medical Services District ("FCPEMSD") and City of Baytown, Texas ("City") entered into an Interlocal Agreement for, among other things, the funding of two (2) Pierce Velocity Pumper Trucks ("2021 Trucks") in the amount of ONE MILLION FIVE HUNDRED SEVENTY-THREE THOUSAND THREE HUNDRED FIFTY-THREE AND NO. 100 DOLLARS ($1,573,353.00); and WHEREAS, in January 2022, FCPEMSD and the City entered into an Interlocal Agreement providing that the District shall provide the funds to the City for the actual costs of various programs, including the purchase of fire technology and emergency response equipment; and WHEREAS, on October 13, 2022, the City Council of the City of Baytown, Texas, passed Ordinance No. 15,235 authorizing the purchase of one (1) 2023 Pierce Velocity Pumper Truck ("Engine 7") in the amount of NINE -HUNDRED THIRTY-TWO THOUSAND ONE -HUNDRED FIFTEEN AND NO/ 100 DOLLARS ($932,115.00); and WHEREAS, in the Fiscal Year 2023 Budget, the City's General Fund Vehicle Replacement Fund funded the replacement purchase of Engine 7; and WHEREAS, a total of ONE MILLION FOUR -HUNDRED TWENTY-EIGHT THOUSAND FIVE HUNDRED FOURTEEN AND NO100 DOLLARS ($1,428,514.00) now remains owing to the City for the purchase of the 2021 Trucks and Engine 7 as follows: • ONE MILLION EIGHTY-FIVE THOUSAND FIVE HUNDRED SIXTY-EIGHT AND N01100 DOLLARS ($1,085,568.00) for the 2021 Trucks; and • THREE HUNDRED FORTY-TWO THOUSAND NINE HUNDRIiD FORTY-SIX AND NOI100 DOLLARS ($342,946.00) for Engine 7; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT: Section 1: That the Board of Directors of the Baytown Fire Control, Prevention, and Emergency Medical Services District requests that the City waive the remaining reimbursement payments for the Two (2) Pierce Velocity Pumper Trucks and Engine 7 in the total amount of ONE MILLION FOUR HUNDRED TWENTY-EIGHT THOUSAND FIVE HUNDRED FOURTEEN AND NO, 100 DOLLARS ($1,428,514.00). Section 2: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Fire Control, Prevention, and Emergency Medical Services District.
