AREA WATER AUTHORITY AUTHORIZING CHANGE ORDER NO.3 WITH
LEM CONSTRUCTION COMPANY, INC., FOR THE BAYTOWN AREA
WATER AUTHORITY'S FRITZ LANHAM WATER TREATMENT PLANT
FILTER AIR SCOUR IMPROVEMENTS PROJECT IN THE AMOUNT OF
TWO HUNDRED FORTY-FOUR THOUSAND SIXTY-EIGHT AND 22!100
DOLLARS ($244,068.22); AND PROVIDING FOR THE EFFECTIVE DATE

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA
WATER AUTHORITY:
Section l: That, subject to the approval of the City Council of the City of Baytown,
Texas,the Board of Directors of the Baytown Area Water Authority does hereby authorize Change
Order No. 3 with LEM Construction Company, Inc.,for the Baytown Area Water Authority's Fritz
Lanham Water Treatment Plant Filter Air Scour Improvements Project. A copy of said change
order is attached hereto, marked Exhibit "A" and made a part hereof for all intents and purposes.
Section 2: That, subject to the approval of the City Council of the City of Baytown,
Texas,the Board of Directors of the Baytown Area Water Authority hereby authorizes the payment
of an amount not to exceed TWO HUNDRED FORTY-FOUR THOUSAND SIXTY-EIGHT
AND 22,100 DOLLARS ($244,068.22) to LEM Construction Company, Inc., consistent with the
change order authorized in Section 1.
Section 3: This resolution shall take effect immediately from and after its passage by
the Board of Directors of the Baytown Area Water Authority.

Brief Description of Chances:
LEM Construction is in the process of rehabilitating the filter system at BAWA Fritz Lanham Water Treatment Plant and has encountered
several issues due to field condition change.The valves originally designated to Isolate the filters are failing to retain water from each filler
while the work is being performed. The inability to retain water from the fillers has created an issue with the removal of the old media and
the installation of the new media and the new air grid air scour system. Both processes require the media to remain dry in order for proper
disposal and installation.The addition of 2"drains to Filters 1,2,3,4,5,and 6 will help keep the water off the media for proper removal
and installation.
LEM Construction Is also replacing the inlet and outlet valves on the Ground Storage Tanks damaged during the February 2021 Freeze
events(Storm Viola and Uri).The valve F from the High Service Pump Station is experiencing valve closure failure A 48"Line stop will
help isolate the outlet valve of Tank B for removal and replacement.

butterfly valve. This is for Filters 2, 3,&6. Filters 4&5 shall be submitted seperatley.
Add 2"Sch80 PVC Pipe from three filters 23 and 6.(3) 12"X 2" Back wash Line taps routed to the Existing Sump Pump Pits.
Mount 2" Drain piping on unistrut supports, and install 2-in ball valves on headers connecting more than one tap for redundancy.

We are pleased to offer the below pricing for the following changes:
On Filter Number one,we experienced a valve closure failure on the the filter that was supposed to be without water on the filter
while we worked.This Change in conditions made us have to bring in the use of Vacuum boxes to decant the filter media.This was
not part of the project, removing water whilst we worked replacing the media.Through our efforts and additonal pumps that LEM
Construction provided.We were able to successfully install and repair Filter#1.These Overages that are a real cost to LEM
Construction represents the cost to our subcontractor Speciialized Maintenance.We are asking for this change in condtions to be
appropirated for.We have found the solution to valve failure on the remaining filters and will request the proposal going forward.

The Filters 4&5 have substantial water leakage. During our investiagtion wih BAWA operations it was witnessed to have leakage
rates over 155 gallons per minute respectfully. This change of condtion will not allow for just sump pump suction; but these two
filters need to be pulled down via a centrifugal pump.Our plan is to utilize the 2 inch saddle tap and connect the pump to hard pipe
and draw down the filters manually.This pump will remain for future maintenance of the filter. Please see attached quotes and
pricing.This pricing covers Filter 4, 5,& 1.
