2023 03 02 CC Minutes, Special MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN March 2, 2023 The City Council of the City of Baytown, Texas, met in a Special Meeting on Thursday, March 2, 2023, at 5:04 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Bay- town, Texas, with the following in attendance: Laura Alvarado Council Member Kenrick Griffith Council Member Mike Lester Council Member Brandon Capetillo Mayor Jason Reynolds City Manager Scott Lemond City Attorney Raquel Martinez Deputy City Clerk John Stringer Sergeant at Arms Mayor Capetillo convened the March 2, 2023, City Council Special Meeting with a quorum present at 5:04 P.M. All members were present with the exception of the absences of Council Member Sarah Graham,Council Member Heather Betancourth,and Mayor Pro Tern Jacob Powell. 1. PROPOSED ORDINANCES a. Second reading of an ordinance adopting a proposed moratorium prohibiting any new multi-family zoning amendment requests for 120 days. Planning and Development Director Martin Scribner informed Council the item was the second and final reading of the ordinance. It would put the moratorium in to effect the next day and the 120 days would be up on July 1, 2023. Within that time, Staff would complete a housing needs assessment and would present that to the Planning and Zoning Commission and Council. A motion was made by Council Member Laura Alvarado and seconded by Council Member Kenrick Griffith to approve Ordinance No. 15,374, related to Item l.a. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Kenrick Griffith, and Council Member Mike Lester Nays: None Other: Council Member Sarah Graham (Absent), Council Member Heather Betancourth(Absent), and Mayor Pro Tem Jacob Powell (Absent) Approved City Council Special Meeting Minutes March 2,2023 Page 2 of 3 ORDINANCE NO. 15,374 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ENACTING A TEMPORARY MORATORIUM ON THE ACCEPTANCE, AUTHORIZATION,AND APPROVALS NECESSARY FOR SUBDIVISION, SITE PLANNING, DEVELOPMENT, AND CONSTRUCTION OF MULTIFAMILY UNITS IN THE MFI, MF2, AND MF3 ZONING DISTRICTS AND PLANNED UNIT DEVELOPMENT DISTRICTS; PROVIDING FINDINGS OF FACT; PROVIDING DEFINITIONS; PROVIDING APPLICABILITY; PROVIDING PURPOSE; PROVIDING ENACTMENT; PROVIDING DURATION; PROVIDING FOR EXTENSION; PROVIDING EXCEPTIONS; PROVIDING EXEMPTIONS; PROVIDING FOR DETERMINATIONS; PROVIDING FOR APPEALS; PROVIDING A CONFLICTS CLAUSE; PROVIDING SEVERABILITY; PROVIDING ENFORCEMENT; PROVIDING FOR A PUBLICATION AND EFFECTIVE DATE THEREOF. b. Consider an ordinance authorizing an Interlocal Agreement with the Baytown Municipal Development District for funding the purchase and use of 5335 East Road Baytown, Texas, in association with the Wayne Gray Sports Complex Parking Expansion, and authorizing payment of additional funds by the City of Baytown to complete the purchase of the property. Public Works and Engineering Director Frank Simoneaux relayed the item was for an Interlocal Agreement between the Municipal Development District (MDD) and the City of Baytown. The City had an agreement with the landowner and the City was ready to close their side of that agreement. Mayor Capetillo commented it would be a great addition for some needed parking. A motion was made by Council Member Kenrick Griffith and seconded by Council Member Laura Alvarado to approve Ordinance No. 15,386, related to Item 1.b. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Kenrick Griffith, and Council Member Mike Lester Nays: None Other: Council Member Sarah Graham (Absent), Council Member Heather Betancourth(Absent), and Mayor Pro Tem Jacob Powell (Absent) Approved ORDINANCE NO. 15,386 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN INTERLOCAL AGREEMENT WITH THE BAYTOWN MUNICIPAL DEVELOPMENT DISTRICT FOR THE PURCHASE AND USE OF 5335 EAST ROAD, BAYTOWN,TEXAS, IN ASSOCIATION WITH THE WAYNE GRAY SPORTS COMPLEX PARKING EXPANSION; City Council Special Meeting Minutes March 2,2023 Page 3 of 3 AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN THE AMOUNT OF TWENTY-FIVE THOUSAND FIVE HUNDRED SIXTY-SIX AND 70/100 DOLLARS ($25,566.70) FOR ADDITIONAL FUNDS NEEDED TO COMPLETE THE PURCHASE OF THE PROPERTY;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 2.
