AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
EXTENDING THE DETAIL PLAN OF THE CROSSINGS PLANNED UNIT
DEVELOPMENT DISTRICT; MAKING FINDINGS; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, on May 27,2021,the City Council of the City of Baytown,Texas,passed Ordinance
No. 14,733 approving the detail plan to create The Crossings Planned Unit Development District (the
"PUD"); and
WHEREAS, Ordinance No. 14,733 provides that the detail plan shall expire on March 25, 2023;
and
WHEREAS, Bobcat Land & Development, LLC, General Partner ("Bobcat") of Bayten, Ltd.
("Bayten"), one of the owners of the PUD property, is requesting a twelve (12) month extension of the
detail plan "due to rising interest rates," that made it difficult for Bayten to 'obtain[] financing until
recently . . . ;" and
WHEREAS, Bayten has now 'obtained sufficient financing . . . to move forward and closing
should happen in the next 30 days;" and
WHEREAS, Section 2.08(g) of Article 11 of the Unified Land Development Code of Baytown,
Texas ("ULDC") provides that the City Council "may, prior to expiration of the detail plan. foi good
cause shown, extend for up to 12 months the time for which the detail plan is valid;" NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: The matters and findings contained in the preamble hereof are declared to be true
and correct and are hereby adopted.
Section 2: That the City Council of the City of Baytown, Texas, finds that Bobcat requested
its twelve (12) month extension, and Council has considered the request prior to the expiration of the
detail plan.
Section 3: That the City Council of the City of Baytown,Texas, finds that Bobcat,on behalf
of Bayten and the PUD,has shown good cause to grant the extension.
Section 4: That the City Council of the City of Baytown, Texas, hereby extends the detail
plan for a period of twelve(12)months.
Section 5: That the extended detail plan shall be valid until March 25, 2024. If a building
permit has not been issued prior to such date,
a. the detail plan shall automatically expire and no longer be valid;
b. the PUD zoning district designation and development standards revert to Livable Center(LC)
Zoning District,which is the underlying zoning district; and
c. all future phases of the planned unit development are also expired.
Section 6: Nothing contained herein shall be construed as to authorize any variance,
exception, or deviation from the ULDC.
Section 7: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
