Ordinance No. 15,406 ORDINANCE NO. 15,406 AN ORDINANCE OF TILE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING ORDINANCE NO. 15,254 TO MODIFY WINK TO WEBSTER PIPELINE, LLC'S PIPELINE PERMIT NO. 1906, TO INCLUDE PERMITTING INSTALLATION OF ONE (1) MODIFIED 36-INCH PIPELINE AND ACCESS THROUGH AND CROSS UNDER GARTH ROAD, WEST BAKER ROAD, WEST CEDAR BAYOU LYNCHBURG ROAD, NORTH MAIN STREET, EAST ARCHER ROAD, AND BARKULOO ROAD, ESTABLISHING THE AMOUNT OF TIIE BOND; AUTHORIZING AND DIRECTING THE CITY ENGINEER TO PERMIT SITE MAPS AND PLANS; PROVIDING OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR TI IE EFFECTIVE DATE THEREOF. ****************************************************************************** WHEREAS, on October 27, 2022, the City Council of the City of Baytown, Texas (City Council) approved Ordinance No. 15,254, authorizing the approval of Permit No. 1906 to Wink to Webster Pipeline, LLC, for one (1) new 36-inch crude products pipeline in the city limits of Baytown, Texas (hereinafter referred to as the "Pipeline"); and WHEREAS, Wink to Webster Pipeline, LLC, submitted a modified pipeline application to install additional pipe onto the Pipeline and access through and cross under: Garth Road, West Baker Road, West Cedar Bayou Lynchburg Road, North Main Street, East Archer Road, and Barkuloo Road (hereinafter referred to as the "Modified Pipeline"); and WHEREAS,the City Engineer, based upon the assessment of the Director of Planning and Development Services, the Fire Chief, the Director of Public Works and Engineering, and the Emergency Management and Preparedness Coordinator as to compliance with Article V of Chapter 34 of the Code of Ordinances of the City of Baytown, Texas, and based upon his examination of the application and plans for the Modified Pipeline, has issued a report to the City Council recommending granting a modified Permit No. 1906 for the Modified Pipeline; and WHEREAS, the City Council received such report and determined that, based upon the representations of Wink to Webster Pipeline, LLC, the application meets all applicable provisions of Article V of Chapter 34 of the Code of Ordinances of the City of Baytown, Texas, as well as all federal and state regulations; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Ordinance No. 15,254 is hereby amended by removing the text and Exhibits of Section 1, and said section is replaced with a new "Section V to read as follows: "That, subject to receipt of the bond specified in Section 3 hereof, the City Council of the City of Baytown, Texas (City Council) hereby grants this Modified Pipeline Permit No. 1906 to transport crude product and provide access through and cross under the following: Garth Road, West Baker Road,West Cedar Bayou Lynchburg Road,North Main Street, East Archer Road, and Barkuloo Road; which shall be installed, located, and maintained in accordance to Chapter 34 of the Code of Ordinances of the City of Baytown and as illustrated in the permitted site maps and plans provided for in this section. The City Council authorizes and directs the City Engineer to execute such permit on site maps and plans, which are more particularly described and attached hereto as Exhibit "A" and incorporated herein for all intents and purposes." Section 2: That, subject to receipt of the bond specified in Section 3 hereof, the City Council of the City of Baytown hereby authorizes and directs the City Manager and the City Clerk to execute and attest to an indemnity agreement with Wink to Webster Pipeline, LLC, corresponding to the Modified Pipeline. Section 3: That the City Council of the City of Baytown hereby establishes FIVE HUNDRED THOUSAND AND NO;100 DOLLARS ($500,000.00) as the amount of the bond or other form of security satisfactory to the City, which shall be tendered prior to any construction, repair, adjustment, relocation or replacement of the Modified Pipeline,pursuant to Section 34-233 of the Code of Ordinances, Baytown, Texas. Section 4: That this permit shall expire 30 years after the date of this ordinance. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
