Ordinance No. 15,375 ORDINANCE NO. 15,375 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, TO RENEW THE DESIGNATION OF THE PORT 10 LOGISTICS REINVESTMENT ZONE; TO EXPAND ITS BOUNDARIES; MAKING VARIOUS FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ***************************************************************************** WHEREAS, pursuant to Ordinance No. 13,709, the City of Baytown, Texas (the "City") established the Port 10 Logistics Reinvestment Zone (the "Zone") under the Property Redevelopment and Tax Abatement Act,Chapter 312 of Texas Tax Code,as amended(the"Act"), to promote the development and redevelopment of the Zone; and WHEREAS, the City Council desires to renew the designation of the Zone in accordance with § 312.203 of the Act; and WHEREAS,the City Council desires to a expand the boundaries of the Zone in accordance with § 312.201(b) of the Act and § 311.007(a) of the Texas Tax Code; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: The City Council hereby finds that the statements set forth in the recitals of this Ordinance are true and correct, and the Council hereby incorporates such recitals as part of this Ordinance. Section 2: That the designation of the Zone as a Reinvestment Zone under the Act is renewed. Section 3: That the boundaries of the Zone shall be expanded to consist of a total of 265.7534 acres of land, more particularly described in Exhibit "A," which is attached hereto and made a part hereof for all intents and purposes. Section 4: That this ordinance shall serve as notice to every taxing unit in which the property within the boundaries of the Zone is located of the expansion of the Zone by the City, and the City Clerk is hereby directed to send certified copies of this ordinance to all such affected taxing units. Section 5: Should any portion or part of this ordinance be held for any reason to be invalid and unenforceable,the same shall not be construed to affect any other valid portion hereof, but all valid portions hereof shall remain in full force and effect; and to this end, all provisions of this ordinance are hereby declared to be severable. Section 6: Except to the extent amended by this ordinance, Ordinance No. 13,709 remains in full force and effect. Section 7: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
