AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING FINAL PAYMENT OF THE SUM OF THIRTY-FIVE
THOUSAND THREE-HUNDRED SEVENTY-SEVEN AND NO/100 DOLLARS
($35,377.00)TO GATEWAY TEN BUSINESS PARK, LLC, IN ACCORDANCE
WITH THE COST-SHARE AGREEMENT DATED MAY 17, 2021; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown entered into a Cost-Share Agreement with Gateway Ten
Business Park, LLC, for the purpose of increasing the size of the sanitary sewer line along IH-10
and Sjolander Road from an eight-inch (8")diameter line to a twelve-inch(12")diameter line(the
"Project"); and
WHEREAS, the maximum amount of the City's share under the Cost-Share Agreement is
$35,377.00; and
WHEREAS, all of the said improvements have been performed and completed in full
accordance with the Cost-Share Agreement; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS;
Section 1: That the City Council hereby authorizes final payment to Gateway Ten
Business Park, LLC, in the amount of THIRTY-FIVE THOUSAND THREE-HUNDRED
SEVENTY-SEVEN AND NO/100 DOLLARS ($35,377.00).
Section 2: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
